Hi! I’ve been searching on how to cancel contract of what they claimed to be “ club membership” in Mexico, I guess they call it that nowadays instead of timeshare. I have purchased membership last March 13,2023 unfortunately I am past the rescission period. Do you by chance have any idea how to deal with it? I have been reading threads here but most that I see are within the 5 days period when they cancelled, so I guess you both @Moonster & @Rpvc have better chance of cancelling the contract. The solution that I only know of at this moment was to just stop paying. I am not sure how it will turn out if I stop but I have been considering that. The monthly payment hasn’t started yet but of course I have already paid a hige amount of down payment from my CC. I still tried to send the company a mail to cancel contract,thru the address written in the contract which was in Florida, last March 23. I think that office is tied up with them. Then tried to contact the company itself yesterday, but unfortunately I was told I can’t cancel it and it’s already in term. I was trying to make settlement but the person I have spoken with would want me to speak again with their representative who I believe would just offer to lower the amount but not to cancel the contract so I declined to speak with them. So the phone call needed up threatening me that this will be legal case and that they will embark all my properties which I don’t really have ‍♀️

So i just got an email from sunset:

"Just to inform you that the banking dispute filed by the still partner has been rejected since it is not applicable. Likewise, you are informed that, since an agreement has not been reached, everything related to the legal collection ofbthis contract will be handled by one of the collection agencies that will be assigned for the formal recovery of the signed promissory notes."

Should I be worried? I haven't heard from my credit card company yet..

Absolutely right. I called the credit card company the same day I cancelled to provide initial info. Now I'm collecting all necessary documents, informations like digital time stamps, courier tracking details, necessary mexican laws to support. I will provide an update here once available. Thanks to what i have read in this thread. I learned a lot on what is the right process.
Update. I disputed it to the credit card company and they reverse the transaction. This avoids the interest if I will not pay the cc. I disputed once the resort finalized my cancellation, but they were asking 2-3 more weeks before they reverse the payment. After I disputed, the resort reversed the transaction after 2 days. Now i need to call the credit card to withdraw the dispute.

However, I am still receiving communications from Sunset, such as balance statements showing interest, payment requests, and threats to escalate my case to collections. They have also mentioned the potential cancellation of my membership, which may lead to penalties. Could you please inform me of the measures taken to stop Sunset from sending me collection notices? I look forward to your response. Thank you.

Hello. Unfortunately my husband and I went to a presentation 03/25 and fell for their tactics and ended up joining their membership. They promised us 2 free weeks at all-inclusive 5 star hotels and a cruise. So, we thought why not. The weeks and cruise would've cost us probable what we ended up paying. Getting back home after the 5 day period I decided to look up this company because I tried signing in to their board. I found out after calling them that we had to pay a certain amount of money before we could receive access to the website?!! This was never told to us in the presentation but was in the contract. So I started looking around on Goodle reviews and found all bad reviews :cry::cry: It has been after my 5day cancellation period and we left a pretty good deposit down for this so called "club". Has anyone ever had any luck cancelling after their 5 day period?

hi! any updates on your situation? we are in similar boat.. 1 month in from contract date, we've sent an email to cancel our contract. got a call about 2 weeks later with offer to refinance at a lower rate, and when we declined, he pretty much threatened us. a few hours later, we got a whatsapp message from the representative with an offer to cancel + 1 week accommodation if we pay US$500 lol. our 1st "loan" payment is not due til sep 1st but we've already cancelled our cards.

Clearly stated in the contract to either submit in person or via registered mail to a specific address but not same with what is in the first page of the contract. Idk if that is part of their tactic to later say you did not send it to the right address.

Not only that part but as well as asking to send all materials they provided during the sale and not just your cancellation letter. That may be another tactic to say you missed that part hence the cancellation will be denied.

As of now, we have sent the cancellation letter along with materials via mail, copy via email to seller and to PROFECO. Also called to the bank to inform them of the situation and that we would like to dispute the charge and no further charges from that company be allowed. Bank asked for details and supporting documents. Sent all of it to them via email.

Received a response from the company that they have received the cancellation letter, reviewing with their board of directors 🙄 Now, I am waiting to get the confirmation for the cancellation. Do I think they will? no. But I will also not stop emailing them until they do so.

I see some people here still receive emails from them for past due fees, etc. Goodluck to that company coz I don’t check my emails often if I’m not expecting anything important. I can always trash that email anyway.

If they don’t comply and refund the charge, atleast the bank knows what is going on and that we have tried every possible way to reach out to the Seller to cancel. I believe it will give us more chance of having CC approve the dispute.

Also made sure to delete WhatsApp so that the agent can’t contact us, though, they did txt regular imessage twice. Never opened, deleted and blocked right away.

I did use ChatGPT to streamline my emails and provide me with checklist of what I have to send, etc. Some may not be agreeable to this method but I think it’s a good use of AI especially when you are in a highly stressful situation.

I’m sorry I do not have an answer for those who are out of the 5 business days rescinding period 😔 If it helps, when I reviewed our contract, there is actually a way to possibly use it to recoup what it actually costs or atleast some of it. The deciding factor for us was that we did not like the misleading presentation compared to the actual contract hence the cancellation.

I wish I had seen this thread or posts online about this “membership” or about pitches before we signed. Idk if it was deliberate, but our room did not have good WIFI the whole time except during our last day. So idk if that is a tactic as well.

Congratulations on cancelling on time. Here are two tips for those reading this.

1. If there is more than one address or option listed (email, mail, etc), use it all. A little extra $10 is worth the piece of mind.

2. Once you send it (registered mail for the post office option) with the 5 days (date stamped on the mail), they don't have an option but to refund your money. "Reviewing with the board of directors" is jargon for: let's see if we can convince them to change their mind or let's see if they missed something. If you don't get your money within 30 days, open a credit card dispute.
3. No need for AI for this. No explanation needed. Simply say you wish to exercise your right to cancel within the stated 5 days and include the following:
A. your name and the names of anyone who signed the contract and the cancellation signatures for everyone
B. the date
C. the resort/club you bought
D. contract #
E. Where you signed the contract.

Essentially, information for them to identify what you are cancelling and that everyone who agreed to the contract is agreeing to the cancellation.
The only other thing will be whatever is listed in the cancellation section of the contract.

They actually asked to send the materials (welcome folder) along with the cancellation letter. There is no way I can send that to both addresses. I just followed the exact instructions in the cancellation section of the contract. Only other thing in the cancellation contact is it states that any refunds are issued within 20days post receipt of the cancellation letter.

I spent $68 to have it sent to them next day and they received it in 6hrs. Mailed it at 5pm tuesday and they got it 10:30am weds. I don’t mind paying that or a bit more just to get it to them as fast as possible.

Unfortunately, I am not good with writing formal letters 😅 I did not want to say anything that would have a negative effect to what I was doing. I found it easier for me to use AI to make it short but had all the bullet points I needed there. I went to Mescam website and had to revise the long sample email. I couldn’t think straight due to the added pressure of finishing the letter ASAP, calling the CC company and just the whole stress of finding out the presentation was trash and all the discrepancies in the contract 😵‍💫.

You are right, the “reviewing with the directors” is an attempt to see if we change our minds. I believe that “A LIAR IS AKIN TO A THIEF”. No promises or offers would make us change our mind.

I know I'm not great with math but I think they received it 17.5 hours later........ but still likely well worth the $68 you paid to send it and be out forever from under it.

Smart move to rescind.

Hi everyone,

I am happy to report that we have officially received the cancellation email and a copy of the voucher for the refund to our CC. It has been 20days since they have received our cancellation letter. It’s a stressful wait with multiple attempts from them to contact us but we stuck to email as our preferred way of communication and never answered their calls.

I hope more people read this thread before going into those presentations and I wish no one has to deal with this kind of stress especially during their vacation.

So in your situation you are pretty much out the down payment, some websites like MESCAM say that you can get a settlement by giving the timeshare company you're dealing with a bunch of negative publicity online. However I don't think this will actually work anymore, they we're doing this stuff during the infancy of the internet.

You have a few options with very limited success potential.

You can contact PROFECO and file a complaint if you have evidence that you were served alcohol and you were intoxicated, or that they misrepresented what they're actually giving you. Though even if you have sound evidence PROFECO is just a mediator and cannot enforce the vendor to pay you the amounts owed. You would have to hire an attorney or represent yourself in Mexican Court.

However the part of your contract stating that it's governed by the laws of Florida does give you the opportunity to file a complaint with the Florida Division of Consumer Services, I haven't dealt with them but perhaps they might have more authority than PROFECO.

Your best option is to stop paying all together, it is worth noting that they absolutely can sell your debt to collections and it could potentially effect your credit score. Though with that loser making legal threats against you says to me that he's just peacocking and trying dissuade you.

If you have any other questions I would happy to answer, and please do share the outcome of your situation even if you don't get the you your desired result, it will absolutely help others in our situation.

I would just bluntly tell him that they'll be refunding your money or AMEX will be refunding it for them on their behalf and since you have provided your notice within the cooling off period and fulfilled your legal obligation under the Federal Consumer Protection Law, that you're not interested in jumping through hoops or playing their games because you're not the average mush brain dullard they're used to cheating.

Can I seek you for some advice? November 9th I was celebrating my birthday at Cancun Mexico at Laguna suites, I went to a presentation for Sunset World at Hacienda tres rio. Long story short they said it wasn’t a timeshare that it was actually purchasing equity and if they will get rid of my timeshare I have with Wyndham. on the contracts. I see nothing about the Wyndham cancellation for me, they said they will contact me in some days I believe the contacting in some days so that I will pass the five day cancellation. Now I fear I will still be with Wyndham that I had prior to them and now them also. I sent an email first questioning this, and then I sent an email for cancellation. They called me with a welcome call, but I didn’t want to be welcome. I wanted to discuss the stuff that was missing off of the email contract that was talked about at the desk to sweeten the pot. I’ve contacted the sales rep who actually gave me a text iCloud number not always responsive to the text but when he does, it usually is blank promises although he did call today, which is November 14 about please answer the call of them welcoming me to the club for joining. My question is since I’m really still within a week and I’m not getting responses. Should I contact my credit card company dispute the original down payment and change my credit card information and just be done with it? Or because of that contract should I enjoy some vacations and just realize that I’m stuck thinking I am not going to get my original refund from SUNWORLD. I don’t owe that much more money and I got 24-0% financing. Part of me says I can just go ahead and pay that off and deal with what’s to come what’s your thoughts on the matter?
 
The getting rid of/trading in other timeshares on a Mexican purchase is a frequent lie. As is the Equity claim. You had 5 business days to rescind. You still own the Wyndham timeshare(s).

I do still have the Wyndham timeshare, because they never did do anything with it as a promise during a presentation. I could wait a little longer to see if that ever pans out, but I’m getting the idea like you said it’s a complete lie and I’m sure the longer I wait the worse it is. I think it’s best that I contact my financial institutions where the payments were made and see if I can get that money back. Even if I can’t, they need to change my card numbers so that this scam share never gets another dime of my money. Is confusing, but I feel like I need to stop the bleeding now it’s been a total of seven days even the number they called me from to welcome me is not receiving calls back. The text that the sales person was texting me from. He’s not replying now.

You still own the Wyndham. That is a fact.
The question you have to ask yourself is if you want this shiny new purchase that may not really be useful. If you don't or you are not sure, then you are still within your 5 business days, cancel.
The process to cancel is really simple. The instructions are in the Rescind/cancellation section of the contract. Calling the sales agent is not going to work. They ghosted you till the end of the period so you don't cancel.
If you need more clarification, ask away.

As others have said, RESCIND if you are still within your 5 day period. And yes, sadly you have found out that you still do own your Wyndham timeshare (what you've experienced is the Mexican way of doing business -- which you've now discovered the hard way).

If you are outside of your window of rescission then you may want to consider to just walking away and make no further payments.

DO REMEMBER THIS; You don't own anything in Mexico. Mexican timeshares are really RTU (right to use) contracts for a period of time as long as you continue making your annual "membership" payments.

Now, still want to go to Mexico? Use RCI or Interval International and use your Wyndham timeshare and make an exchange to visit Mexico.

GET OUT NOW. Whatever you have to do get out. Even if your rescission period is over. Cancel the charge with your credit card let them fight it out you don’t have to close the credit card.
Speaking from experience with dealing with Sunset for 20 years and Mexican timeshares for 31 yrs Sunset is not a company you want to get into bed with. They already proved to you they aren’t trustworthy and the only reason your sales person called you was to string you along so they did not lose their commission.

Tres Rios is nice, but there are much nicer resort. If you signed a contract for mandatory AlInclusive that is crazy. You can’t bank it with the exchange company cause it’s worthless. And you won’t want to go there every year. It won’t rent cause it won’t. You thought it was so nice because Laguna is a 2 star resort. People give those Tres Rios contracts away just to get rid of them. At least with Wyndham you have a selection of tons of resorts.
You still own your Wyndham and as close as Sunset will get to taking it in trade is to give you a company to signup with and pay more money to sell the Wyndham and it still won’t sell.

Don’t feel bad or stupid it happens to the best of us. Just get out of it. Your best bet is definitely your credit card company. You have 60 days with them.

The other important piece of advice we give to people in situations like yours is to not go seeking the "help" of these companies, law firms, charities, or other organizations that claim they can get you out of your contract or claim that they can sue the people or company that got you into this mess.

Just take the aforementioned advice of others. You do not need the help of these scam companies.
