I forgot to mention, when I spoke to the representative earlier if I was to cancel how do I do that. He told me that I can’t because it’s a “resale” and that I’ll have to talk to the legal team.
I would just bluntly tell him that they'll be refunding your money or AMEX will be refunding it for them on their behalf and since you have provided your notice within the cooling off period and fulfilled your legal obligation under the Federal Consumer Protection Law, that you're not interested in jumping through hoops or playing their games because you're not the average mush brain dullard they're used to cheating.

You can send it via email but if want "official documentation" then I strongly advise you to also mail a copy via REGISTERED MAIL.... The Postmark makes it official in the eyes of the Government and will hold up should you need to go to Court for any reason.

Be sure to get that Postmark sometime before Tuesday October 8th. Remember, it is the actual date of the Postmark that counts and not when they actually receive it.

By the way, it doesn't matter if it's Postmarked in Mexico or the USA. Just send it via REGISTERED MAIL and be timely on the Postmark. Protect your assets and don't take any shortcuts. It's your money and you worked hard for it!

I’m still in Mexico till Tuesday Oct 8. I sent them an email the same day I signed the contract. And I spoke to someone today to confirm they got my email with the letter attached and they said they did receive it and would get my refund in 15 days. I also already put in a claim with AMEX and uploaded all documents. I canceled all additional benefits/incentives and asked to be moved back to our old room which we are waiting for now

The contract should have the methods of cancellation. Write the same letter, make copies. Sign and date and make sure everyone of the contract signs it. Include the contract number, when it was signed, where it was signed. Drop off a copy since you still there, get one to the post office and get a receipt. Email them if there was an email in the contract cancellation section. Once that is done, give them two to three weeks and if the money is not refunded, open a contest with your credit card and provide them a copy of the cancellation criteria and evidence you cancelled within the correct time frame.

As stated earlier, no need to argue with anyone, meet with anyone from "legal" department or anything that would jeopardize your right to a refund. You don't even need for them to take the dropped off copy from you. Just walk in, tell the receptionist you have a cancellation to drop off and walk out.

By the way, I would STILL mail it for the official Postmark (in case your case somehow gets magically lost in the Mexican email cracks). It's your money. CYA

I don’t have a lot of faith in what they told me. That’s why I already disputed the claims with my credit card and provided the credit card company with documents and as much details as possible. I also have someone mailing the letter for me on Monday, October 7 when the post office opens, which is still within the 5 days from signing of the contract.

I didn’t see anything about upgrades/gifts in the contract but there was a separate paper we signed that says “this service will have no cost for you as a new member/as a first visit in incentive and in the understanding that if you decide to give up your status as a member, it will have a cost.”
I am canceling all the tours and spa they scheduled us. I also plan to move back to our previous room tomorrow if they allow us.. So if they do deduct from the amount hopefully it won’t be too much.
Just to give you an idea, they moved us from ocean spa to sunset royal and we stayed the full duration (since we weren't sure at that time if we wanna cancel or not), we also availed 1 of the gifts they gave us, the rest we cancelled. We weren't charged for those.
 
Hello all, Me and my family have also recently fallen for their tactics and ended up joining their membership this October 16th. We were able write an email for the cancellation on the 19th, also sending it to the profeco email (extranjeros). We have also filed for a dispute with our credit card dcompany. They have used similar tactics of saying that we can't cancel anymore as we have used their gifts (They moved us from Laguna to Sunset Royal as well as two tours one of which was cancelled due to bad weather). We have also started talking with Mexlaw but will definetely reconsider after I came accross this forum and website. I'm here asking for any help on what we should do next as well as confirmation on if an email for cancellation sent to csc@sunset.com.mx will be enough of an evidence for the cancellation. Can send what the email contains if needed.

Im currently on a similar situation and we have already sent an email before 5 days, but we only thought of mailing now (signed contract on Oct 16) which will be exactly the date for the 5th day, should we still send it or will that make it more complicated for us?

Today is October 23rd and now you are at 7 days so I think the question may be too late at this point.

I suppose you could send it REGISTERED MAIL and include a copy of the original dated email which you had previously sent. Be sure to include a letter explaining the entire situation.

Be sure to come back to TUG and report back as to how you finally make out with this.

The use of the "gift" does not negate your rights to cancellation under mexican law. I believe that was already discussed and a link posted earlier in this chat. Don't accept any attempts to convince you otherwise. Don't pay money to anyone for anything.
 
@Moonster , I used DHL to send my cancellation letter when I was in Mexico. Not familiar with Mexico postal. I'm back in Canada but our postal system is on strike. I'm planning to send to UPS another letter. It will be the 4th business day to rescind. Also can you I send you an email?

I know there is a Canadien Postal Strike so I think you have no choice but to use anyone other than DHL, Federal Express or UPS.

Clearly you certainly don't want to get locked in to this timeshare so I would be tempted to send one via DHL and an identical copy via another carrier (but that's just my opinion). You'll have to make your own decision as to what you actually do.

Arranged a meeting with sales agent to recieve my cancellation and he signed. Then emailed it to their VLO Manager. The same day, the VLO Manager acknowledged the receipt of the cancellation. I'm sending additional letter to support the cancellation. I'm not a 100% if it will go through.

It certainly looks like you covered all your bases to cancel. I would think you are finished with them.
 
FYI always always no matter what type of documentation you have sent or receive always alert your credit card to your cancellation. That is your guaranteed line of cancellation.

Absolutely right. I called the credit card company the same day I cancelled to provide initial info. Now I'm collecting all necessary documents, informations like digital time stamps, courier tracking details, necessary mexican laws to support. I will provide an update here once available. Thanks to what i have read in this thread. I learned a lot on what is the right process.
 
Mine went mostly smoothly, I filed the dispute with my bank, they asked me to write up what happened and to send them along any evidence I have to support what I wrote. That went on for months and months with nothing it seemed, but I did eventually have the refund become permanent.

Your best bet would be to phone your bank and ask for next steps, I'm certain there's time limits for how long these disputes can go on for. My bank was very helpful, but YMMV.
Hello. I have some great news! My bank just informed me that I've won my dispute case. The refund become permanent. Does this mean that my contract with the merchant has been canceled? However, I'm still receiving emails regarding the collection of maintenance fees. Should I ignore these collection notices? I would appreciate any advice on what steps I should take next after winning the case. Thank you for your help.
 
Hi! I’ve been searching on how to cancel contract of what they claimed to be “ club membership” in Mexico, I guess they call it that nowadays instead of timeshare. I have purchased membership last March 13,2023 unfortunately I am past the rescission period. Do you by chance have any idea how to deal with it? I have been reading threads here but most that I see are within the 5 days period when they cancelled, so I guess you both @Moonster & @Rpvc have better chance of cancelling the contract. The solution that I only know of at this moment was to just stop paying. I am not sure how it will turn out if I stop but I have been considering that. The monthly payment hasn’t started yet but of course I have already paid a hige amount of down payment from my CC. I still tried to send the company a mail to cancel contract,thru the address written in the contract which was in Florida, last March 23. I think that office is tied up with them. Then tried to contact the company itself yesterday, but unfortunately I was told I can’t cancel it and it’s already in term. I was trying to make settlement but the person I have spoken with would want me to speak again with their representative who I believe would just offer to lower the amount but not to cancel the contract so I declined to speak with them. So the phone call needed up threatening me that this will be legal case and that they will embark all my properties which I don’t really have ‍♀️

I have the same situation. I signed a contract on March of this year and also already made the first payment. I wanna cancel my membership and file a dispute on my bank but I am not sure how to move forward about it. They told us that we will be only paying a certain amount for every booking we will have in the future and when I tried to booked it is way more than the amount they told us. The representative told us we have to call a different department if we were promised something like that but we kept getting different people to talked to and have no idea what is going on. Please help me on what would be my first step be.
