Need to do a reply on my nieces exit from Wyndham. Thought everything finally done but she let me know yesterday that they would not accept the notary's stamp. The person at the bank that did for her only has the letter J for his first name. Now Wyndham wants something fro her bank stating he has no first name only a letter. She is so upset cause this was a legal notary. At this point she not holding out much hope of ever getting out of it. Deanie
How lovely that Wyndham gets to decide whether the name of a notary public, as registered by the state, is acceptable for use on legal documents.

no doubt the initial responses when trying to deal with some independent resorts is usually slanted towards the negative! sometimes its a matter of simply getting ahold of the right person or simply being persistent.

EVERY resort and or association has to deal with surrenders and deedbacks because every resort/association has owners in default. As such in many cases it takes effort and persistence to convince the resort/association they are not going to get any more money from you and it would be cheaper/easier to work out a deedback willingly vs having to suffer thru months or years of default to end up in the same situation they are in now (in having to negotiate a surrender).
Positive progress on our deedback of Wyndham Villas at Fairfield. We received a quit claim deed from Tara Cove Condos HOA 2 days ago. We're getting it notarized on Friday.

We officially started the process this morning (10/08/24) also. The contracts include 2 converted float weeks at Club Wyndham Avenue Plaza, and UDI contracts at Club Wyndham Majestic Sun and Palm-Aire. We will see how this goes.
They had a form on the website that I filled out, but never got a response. I called on Oct. 22, and after a 45 minute hold was able to talk to a rep about returning the timeshare contracts. Based on my contracts, length of ownership, and grandfathered Silver VIP status, I qualified for the Limited Edition Certified Exit. I have points transferred to RCI that I can use up until the do the paperwork with would be about 2 - 3 weeks. After that, I lose all access to RCI. I should receive my paperwork from them in 7-9 weeks of my call. I have 30 days to sign and return the paperwork to them. It was recommended I use certified USPS, Fed-Ex, or UPS. After that it would be 4-6 weeks before my exit is completed. I do have to keep payment of my maintenance fees up to date. The Limited Edition exit will give me 3 years of my 441K points to use maintenance fee free. I will be at the regular non VIP status, and can not use guest certificates. Based on when my exit is complete, my use year of the points for the 3 years may change from Jan-Dec to Mar-Feb or such do to the fact my closing may be after Jan 1. We will now wait and see how this progresses. BTW, the rep I talked to was very courteous and helpful. Also, since having read a lot of posts about them not taking converted weeks back, I think they took mine because it is a very desirable property at Avenue Plaza in New Orleans.

Interesting. I've also heard several people on Facebook mention that they were told that Limited Edition was on hold as of October 1, but your experience (fortunately!) doesn't seem to line up with that. I hope everything goes smoothly!

I am a Notary. I am not surprised that the Notary seal was rejected. It is a legal requirement that the Notary's name be fully printed and legible. It is my experience that many non-lawyer Notary's have never been properly trained as to the legal requirements. Below is an excerpt of the Notaries and Commissioners Act in the jurisdiction that I am licensed. It appears that Wyndam's paralegal is actually doing the due diligence reasonably required on any real estatel transaction.

A notary public shall, on each document attested by the notary public’s seal and signature, legibly print, or stamp in legible printing, next to the notary public’s signature.

The set of things they are (and are not) willing to take is constantly changing. There are no general answers (e.g. "nothing from Fairfield" is almost certainly not true), but instead specific resorts/unit sizes/seasons.

You can transfer to someone else if you can find someone to take it. Depending on what you own, that might not be too hard. Or, you can call again later.

My understanding is that they aren't taking any converted fixed weeks. Most Farfields are older resorts and are more likely to have been sold originally as fixed weeks as yours was, so it may be that currently at least, Fairfield resorts aren't accepted in certified exit.

is that resort still independently owned and just managed by wyndham?

if so have you tried reaching out to the owners association directly?

Tried twice to transfer a small contract at Branson Meadows to a TUG member. Wyndham sends a letter saying that it's not deeded correctly for the COUNTY. The county recorded the deed and said it's absolutely correct. This process started over a year ago, and I am just done with it. Now the deed is legally recorded to a TUG member, but Wyndham's records still show as as owners.

This is gone from nuts to ridiculous. How does Wyndham get to decide what the county accepts OVER the county. It's insane. They also kept our $399 transfer fee.

Because I'm still sitting on a $100 voucher with RCI which can be used to book a Last Call or Extra Vacation, I would like to try getting something booked before starting the surrender. It doesn't expire until Feb 2025, but I know I don't want to start paying 2025 MFs so I need to act no later than Dec 1st on getting this contract surrendered to Wyndham.
WHOOPS . . . bad info from RCI as the $100 voucher expired 10/31. No worries . . . I didn't want to spend $300 to get $100 in value back from a poor customer service issue last December.

The SECOND is what she called a "limited edition" exit, where we would surrender our ownership, which would also take 9-13 weeks and we must also continue paying MFs (which seems fair since we have used our 2024 week and our MFs for this year's use runs through 12/31/24). That said, what doesn't seem quite right or fair to me is that our RCI membership provided through our program fees paid with the MFs, will be discontinued as soon as they start the process by mailing/emailing us the surrender documents. With this exit/surrender process we will receive the ability to use the 77k points at Club Wyndham resorts ONLY for each of the coming 3 years (2025, 2026 and 2027) for no additional fees. (I really need to verify this AGAIN once we notify them to start the process!)

So we did start the process back at the beginning of October. I did a 6 week follow-up with them as I've yet to receive the surrender documents to officially start the process. They did say it could take around 9 weeks, so hopefully I'll see the paperwork soon.

I've owned at Fairfield Mtns for >40 years; converted 1 fixed week to points about 25yr ago. Wyndham tells me they don't own FM so they can't take it back. Tried several times calling and sending certified mail to the resort itself--didn't even get the courtesy of a reply to the letters. I can't give it away and family doesn't want it. Got info from some exit companies but they are scammers and charge a lot of money which I did not pay. I decided 2 yr ago to simply stop paying MFs. Had 2 calls from a collection agency (first one nice, second one not so much); then a letter stating the collection agency turned it back to Wyndham. Nothing in over a year, although Wyndham sends the bill every month, which gets filed.

Any idea on how often Wyndham updates their list of resorts being accepted for Certified Exit? Wondering if should be calling in to check weekly, monthly, quarterly???

Thanks ... I think I will set a reminder to call the first week of every month. Monthly updates to eligibility list seem the most probable to me.

UPDATE ON MY CERTIFIED EXIT

10/4/24 Initiated the process
12/5/24 Received (by email) the documents to sign & return
12/6/24 Sign (with notary) and UPS'ed back to Wyndham

From here it should be 2-4 weeks and the process will be complete.

I received all of the program information which included the contract terms for the Club Wyndham Limited Edition program. For me, it will start 4/1/25 and run for 3 program years . . . 4/1 - 3/31 will be a program year and the 3 years of use will conclude 3/31/28.

I have 77k points (the value of the contract I'm exiting) per year to use, booking 10 months or sooner. No ARP reservations as I no longer "own" or have a "home" resort. No MFs or use fees (additional HK are available for purchase if necessary) . . . still the opportunity to rent points if necessary to complete final day's booking. No guest certificates allowed . . . only for my personal use. And there is a list of resorts that are included in the Limited Edition program. No WorldMarks, but it's a decent enough list that I'm sure I'll use the 3 free years provided as part of the certified exit process.

I called them a couple of weeks ago, about 6 wks after starting the process and they informed me they were still getting everything together. I finally received the email with all the attachments last Friday 12/13. It contained 2 attachments. The first was the document that had all of the paperwork required to turn over the deeds. The 2nd was the document was the New Limited Edition - Ovation explanation document. The first document contained the overview letter, an acknowledgement form we need to sign (did not require notarization), The Limited Edition enrollment form to sign (no notarization required), and the 4 deeds we are deeding back. These require notarization with 2 witnesses, and each had a cover letter with detailed instructions. It also had a pre-paid UPS shipping label to attach to the mailer to mail the documents back. The 2nd document contained the overview of the program along with the reservation process, and a list of the resorts that could be stayed at.
So far the process has been very straight forward and easy to do. I am mailing off the documents today, 12/19, and the process should take between 2 to 4 weeks.
As I was told when starting this process and also covered in the email, my annual usage year is changing from Jan-Dec to Apr-May to allow me a full year for the first year of points. Points usage is just like when you owned the properties except there is no ARP or VIP privileges.
When you look at how much it costs to purchase points for completing reservation that you don't have enough points ($10 per 1000 points), receiving 3 years of points you feel you are being paid back/ selling the points/deeds back to them. In my case they are giving me $13,230 dollars of free usage. Not quite what I paid for my 1st 2 contracts , but still nice. Will keep you up to date on the final process.
