RCI Suspended Eagle Village Tamiment

I am curious what everyone thinks the next step(s) should be. Obviously looking into the by laws and finding out if this vote they held is even legitimate. Not all members are on this page, so figuring out a way to have all of them be notified? Maybe the Pocono Record and the Poconos Times would like to do an in depth article on what's going on here. The hostile takeover, the deceit with construction bids and financial transparency, the lawsuits surrounding the man who is attempting to take over. Maybe they'd be able to at least get a statement out of him, since all we can get is his abrasive lawyer and fake accounts claiming to be a former dairy farmer. I think that might be the best way to get to the bottom of this
 
I own a timeshare in Florida. Capital Vacations has taken over. This year's annual meeting was canceled because there wasn't a quorum. I will not hear about anything until they send their annual newsletter in June, and tell how the board filled the empty positions because there wasn't a quorum and what the budget and plans are. Its all once a year. It's all according to the Rules and Regulations and Covenent. It's all legal. Nothing I can do.
 
I just want to state, I don't think 194725RR is John Oakes.
It's above a 94% certainty that it is. Go back and look at his comments throughout this post. It took a little research, but it's him. His syntax from public statements is spot on, and with what he has been pushing, it's to undermine the current staff/board and get folks to sell their deeds back.

FlorRidatraveler2007, You’ve got some great ideas and valuable points. It’s kind of funny to me that you think I’m John Oakes. Actually, I think you might be Tom Cruise. You kind of talk like him. Plus it seems you think this current mission might be impossible.

- what, in detail, work is being done? From what owners saw from their walk through last week, it is incredibly underwhelming and looks like the beginning of another scam
- of the 906 deeds Bushkill PA LLC now has, how many are current on their dues and fees?

Those are some really good points and questions, Tom. I assume you typed them with one hand while hanging onto the outside of an airplane with the other? Honestly, I do get to write off a few hundred dollars of school supplies on my taxes. I hope John does good things for Eagle Village and its owners. People can say who they are, but people’s actions really tell the truth. I really don’t have anything substantial to contribute at this time due to being an actual school teacher and former farmer. I hope this quick dialogue brought some levity to the situation. I’ve got to get back to work.

I see two options. One is to contact an attorney to sue the BOD for failing to uphold their fiduciary obligations to owners. They failed to produce budgets, follow the budgets, and hold elections last year. They aligned themselves with an investor who has played his hand now in trying to take over the BOD. This puts you all in a bad position since his company can set the budget, special assess, and push more owners out over time with the goal of eventually being PAID to receive ownership of the property. Eagle Village may not have much value as a Timeshare but the land, clubhouse/pool, and existing structures do have value of course. A proper BOD would have looked at the balance sheet and at least offered the option of closing the operation and selling off the property. If John Oakes was able to obtain a majority stake this quickly the owners association could have accomplished the same. The sale would net each owner their fair share. Instead we are paying John Oakes to acquire the property in small slices. What a great deal for him.

The second option is two cross your fingers, hope for the best, and wait for the inevitable maintenance fee increases and special assessments to roll in. Worse yet is if his company is not successful and fails to pay contractors resulting in liens placed on the units.

I do hope it works out for you all but it will likely work out best for John Oakes.

I really think the fact that they have not been giving us a financial statement is something that can be reported. Someone mentioned contacting the local newspaper in the Pocono's and let them know what is happening/not happening at Eagle Village is a good idea. Even if they try to contact John Oakes and do an article about the new and improved Eagle Village and all they plan to do to update the resort, might be a good way to hold him accountable. Is there any one local who can contact the local newspaper? If not, and I get enough people to say its a good idea, I will contact them. Just post what you think.
 
Good luck to everyone who has stayed around EV. We did the $2500 escape last year and are on our last day of our last Points exchange using left over points that RCI did not take away. For those on the fence - we are very glad to not be a part of the EV mess any longer. It was well worth the money to be done with it. Been a while since I checked in to this board as things looked like they might be turning around - not so much now.

The place we are at in FL right now has been renovated and is pretty nice contrary to some of the reviews that reported lots of mildew - something we have found all too common in exchanges. But we are very very tired of the extortion attempts at many exchange properties where they withhold a parking pass or gate key to the pool etc etc unless you agree to a high-pressure sales pitch. That was a problem at this place on Saturday when we checked in. It is also the lying by the front desk staff that the 90 minute “information presentation” (that always turns into 2-3 hours) isn’t a sales pitch. We pay a lot of money to join RCI and then a lot more for an exchange fee to put up with the high pressure extortion attempts at check-in and RCI does nothing to stop this.

We have been to some nice timeshares since 1998 when we bought at EV - but far too many have had cleanliness issues or have been like this one with the high-pressure sales. The nice ones (clean with no extortion) are also the ones hardest to re-book through RCI - although we have had some luck re-booking a (non-RCI) rental directly with the resort at some places. We are thankfully done with timeshares. In our future travels we will use hotels, private condo rentals through personal referrals from friends and the occasional VRBO in our home state where rip-offs by owners have been rare. If that is not sufficient - we’ll stay home.

I continue to read the post and make comments because even though I am glad we are out, a part of me still gets angry due to the fact that my parents gave us their timeshare a timeshare that we spent many summers there having a great time and I was looking forward to sharing that experience with our grandchildren. Some might say, you got your money worths, but think about this, until a couple of months ago when it became easy as pie to sell back your deed, if we would have contacted Eagle Village a year or two ago and said, we want out, we got our money's worth, Eagle Village would definitely not have said, no problem, we got our money's worth out of you too so you can get out of your timeshare. No, they would have said, no way, you signed a contract, you are in this until death do we part and even then, if you have children, they would have had to take over the timeshare.

What my point is, we paid or in our case my parents paid maintenance fees for 30+ years and now have nothing in return. In fact, we had to pay money to get out and now John Oakes made it easy for us to get out. He made us feel uncertain and scared about the future of Eagle Village. Were we going to have to pay high assessment fees, etc. Except for some videos showing a bulldozer knocking down some trees, he never let us know exactly what the plans were. He never told us what went out to bid and who got the bids and what each person contracted was going to be doing. He did not even show up at this last meeting, which that alone speaks volumes about the lack of transparency he has shown to us. Bottom line, he took advantage of us.

The bigger problem is if you live in a different state at the time of passing, then it requires filing probate in the state where the real estate is owned (in this case PA). If fully paid up and all that is left is maintenance fees, assessments and taxes it may be best to offer the deed in lieu of foreclosure and if rejected, just stop paying and wait for them to foreclose. If you are older and not in need of "credit" it wont mean a thing.

Not sure what you are saying about timeshares being transferred to children. My sister and I are concerned about this because our parents have a couple of other timeshares. Will we have to take them over even if we don't want them?

NO, absolutely not. If you are not on the deed, you are not legally a property owner. Your children don't own your house, do they? They are not responsible for the mortgage or upkeep. Same for a timeshare.

 
I seriously thought about transferring my timeshare to my 96 year mother before she died, as a way out. Just didn't get around to it. But if I had, that would have been an end to all this.

I am saying this: "Children, as long as they are not on the deed, do not have to accept ownership or any inheritance". If you are named in a will to inherit something you dont really want you do not have to accept it, you legally can decline the inherited item. Understanding that, do you really want to name them and stick them with something they likely dont want...

No, I don't want my children to have this timeshare, that's why we sold it back, but I mentioned my parents still have some timeshare and me and my sister were concerned we would be stuck with them someday. If we are able to decline them, that's good to know.

Ask your parents to not include the timeshares in their will (or put them in a trust if they feel they must hang on to them). If those timeshares are in a different state from where they live, it will require ancillary probate in the state or states where those timeshares exist. Some TSs are more desirable and have some value, some are easy to give away, some have negative value (EVT is such a place). It is best to get rid of them before passing and have them drag on estate settlement even if it means letting it go to foreclosure.

Just remember, if those TSs are in a different state from where they live they will still require probate in the state where they are located(at expense of the estate) and they will need to be notified of the death along with the fact that no one is claiming them.

Great News! Decorum is being followed. Eagle Village just sent out a notice that on 2/28/25 at 10:00 am a meeting of the timeshare interest owners will take place for the purpose of removing 3 or more directors and to elect successor directors to serve beginning immediately with staggered terms.
