Need help please (sales rep lied to me)

A short while later, I heard from Yamaki again.

“As part of the settlement, I have agreed to remove all my comments about Hilton Grand Vacations in social media,” she said. “Therefore, I hope you would not write a story about my case.”

Oh no. A few companies force their customers to sign a nondisclosure agreement when they issue refunds. But I had been in contact with Hilton Grand Vacations, and I didn’t think the company would do that.

So I asked them: Did you ask Yamaki to take down her social media posts and to sign a nondisclosure?

The answer: No, we didn’t. She is free to talk about her case.

Hilton Grand Vacations also apparently contacted Yamaki to reassure her that she could talk to me and would still get her refund.

A short while later, she emailed me again.

“Hi Chris, Hilton Grand Vacations did not ask me to remove social media as part of the condition of cancellation of my timeshare purchase,” she said. “I apologize for any misunderstanding. I told Hilton I would remove social media about my complaint since Hilton agreed to cancel my timeshare purchase and to issue a full refund. Please do not write a story about my case nor proceed any further work on my behalf.”


Apparently the OP has remorse for HGVC for beating them up!
 
Apparently she doesn't like reading contracts and then she plays the victim. The post heading should have been "Need help please (I don't read contracts). :)
of course, that probably explains many of the unhappy HGV owners....never read the contract, didn't understand the contract, don't read the club rules....then blame HGV. (not saying that some blame shouldn't be there since the sale's folks do stretch the truth or outright lie) but come on people, who goes out and pay tens of thousands of dollars without understanding what you are buying....and then refuse to read the club rules to understand how to use that purchase.
 
As a general rule, society doesn't read contracts or terms and conditions, at least not for most consumer purchases or enrollments. When was the last time you just clicked the "I accept the terms and conditions" w on a website without reading them. I would say more people don't read them than do. They make them long and hard to read on purpose. So people don't read them but then can claim that you agreed you did even though they wrote them in a way they know you wouldn't.

I read all "contracts" and most terms and conditions if I feel that it could be something important like changes of services...but not all.

I haven't had the need to read many contracts, but I would agree on contracts. I read them all. As for T&C, you are in the minority. Have you read an airlines contract of carriage prior to booking every flight? If you have, again, the minority.
 
At the least, you have 10 days or what not to read the agreement in time to cancel even if you don't have time to read during the high pressure sales meeting. So there's no excuse.

no. I have glanced down the page when they send updates out about changes to services for Delta....that that is probably it since that is who I fly the most. I admit, that I have never read the same pages for other airlines that I have taken on occasion. I figure they are all about the same.

I read the contracts and terms in cases where I think it's important. In the majority of cases, I decide that I don't need to read the details for various reasons and generally just sign after skimming the preamble. As far as I can recall, I have yet to run into an issue with this, and I've saved a lot of my time. I don't think it's that hard to know which things/organizations are OK to sign and which require scrutiny.

As a travel geek, I likely know more about various travel T&Cs than most (with the notable exception of my Flyertalk peeps) :)

They really need to follow the method of the UK with a two week cooling off period where either party can cancel for any reason. Some of the properties are like 3 days to rescind so folks aren't even back from vacation yet....and locked in.

Social media can be very powerful and give your average consumer more power against timeshare companies. Maybe longer term this will cause the companies to tone down their lies and deception.

Likely. But many folks do know to reach out to social media channels in cases like this, even without reading prior art. Social media is insidious and prevalent. And, occasionally, useful.

I am not sure the rukkus caused it or she convinced them that the sale's person lied about the OS rates and the M - Th deed but it worked.

Yes - there are partial week deeds at The Quin and The Central.
seems like an odd deed. Who consistently uses a partial week at a property? I guess it is a cheaper way to own at an expensive property....I definitely would not pay $28k for a 4 day TS.

I just read this entire six page thread. I was struck at how helpful and knowledgeable tuggers are to people like the OP. Such great advice, along with detailed ways in which she could make lemonade from the lemons. I found her replies to be overly emotional, ungrateful, and not very smart. I’m a little disappointed that her tantrum gave her the positive outcome she was seeking. Lol.
 
the OP asked me to delete this thread as well, citing that part of the agreement to get a refund was that everything gets deleted off social media.

when I requested the language from hilton demanding that as part of the "settlement", they stopped responding. Now we have an explanation.

They, as in, the OP or HGV? Thanks for leaving it up. Like @Smclaugh99 said, Tuggers gave good advice to the OP. That is what this group is about and for others to read through the questions and responses.
 
sorry yea, ill edit that to be more clear. the OP requested it....repeatedly. but always refused to provide anything from HGVC where they had stipulated that as part of the deal.

I mean the outcome was great, but it certainly was not fair to delete this entire post and all the replies within it vs leaving it up for anyone that may encounter a similar issue to find and read.
 
It seems that the OP was using deleting negative comments as some sort of bargaining chips like as if it were somehow important or powerful. As Christopher mentioned in the article, negative social media hasn't led to cancellation of a contract. Look, timeshare companies probably have more negative coverage on social media than any other industry. People who are buying aren't reading social media or really doing any other research before they sign, so this thread or any other negative commentary really doesn't impact them. Thus why they didn't stipulate it to be removed. Perhaps the OP thought they were under some sort of moral obligation because they threw it out there that they would remove their negative commentary when negotiating with HGV?
 
My opinion only.

Seems fishy that OP would lie about needing to delete all these public posts as a condition of her refund. Why delete them if it was not part of the settlement?

To me, this casts doubt that her version was 100% true like she claimed. Namely open season for $50 a week.

Per Elliotts article, she tried to get Elliott to not publish the story. She claimed (under the contract she signed asking for help) that Elliott would only write story if Elliott negotiated or mediated the case. According to her since he had been of no help he could not write it. Clearly she interprets things to her advantage.

Glad the outcome was a refund to OP because the sales people do lie or tell half truths.

On the other hand it seems that "oil the squeaky wheel." is the way to get your way. Society on a downward spiral is the way I see it. More people will be acting out until they get their way.
