Rescinding Bluegreen Certified Mail Not Signed

Per the Tennessee instructions for contract rescission, I sent a notice of rescission to the address provided via USPS certified mail with return receipt:
ATTN: Corporate Sales Accounting Dept.
Bluegreen Vacations Unlimited, Inc.
4960 Conference Way North, Suite 100
Boca Raton FL 33431

The tracking number indicates that USPS attempted delivery today and was unable to deliver (the package is now at the post office for pick up). I am aware of the hurricane affecting FL at the moment which may have contributed to the delivery failure. Is there anything I should do to ensure that I have delivered notice within the window? I am worried that it will be returned to sender before they receive the notice.

I signed the contract on 9/17 and I sent the notice 9/22. Tennessee has a 10 day rescission period.

Wright up a new letter and drop it in the mail with a plain old first class stamp. Provide some details about the letter previously sent with the tracking number. In the event they don't get the one you sent certified, this may help as a backup.

I wouldn't do anything. It will be picked up AND it doesn't matter when, as it's the postmark that determines when the rescission letter is sent, NOT when it's picked up.

I'm guessing they kind of have their hands full in Florida today and the clerk didn't want to stand in a line to sign for a certified letter.

I appreciate your reply.

In my OP I did acknowledge the hurricane and definitely hope that the staff at their office are safe and understand this mundane task will be delayed. My post is only about protecting myself if the letter goes unclaimed (or gets destroyed in the storm).

Regarding picking up the letter, it does make me feel better that certified mail is kept for pickup for 15 days. In the past i have sent packages that were only kept for a few days.

I may send another letter postmarked tomorrow which i believe is my last day in the 10 day window, for the small chance the letter is not picked up.

You have all the proof you need. A postmarked receipt and tracking number which indicates the date of mailing which is all you need........ Sit back and relax!

Remember; It is the actual date of mailing that counts!
