Hello everyone,

I am considering gifting/transferring my Marriott timeshare condos to my daughter as a family transfer.

Has anyone here gone through this process with Marriott Vacation Club?

If yes, could you please share your experience? I would be interested in knowing what steps were required, what documents had to be completed, whether Marriott charged any transfer fees, how long the process took, and whether there were any issues or surprises along the way.

Yes. I don't think you can do this all through MVC.

When my mom transferred her MVC ownerships to my sister and I, we used LT Transfers (lttransfers.com, I think) who is expert at timeshare transfers. I believe the cost was around $400 for each VOI, which included all of the title work and their interfacing with MVC. I seem to remember there was also a small fee payable to MVC ($25?) which may have been included, I don't remember.

Make sure that LT knows that it's a parent-to-child transfer, they will get you the proper MVC paperwork so that it's processed as such and your ownership benefits transfer to your daughter unscathed.

I don't think there's a better way to do it than to go through LT Transfers, they made the process easy.

I'd be surprised if Marriott doesn't charge a larger fee.
After my husband died, I simply wanted to take his name off the account, mostly because all communication said "Dear John". The cost, more than $100 seemed senseless. I left it as it was and convinced someone to put my name on top.

Yes they have a change of primary owner process internally.

No and no, unfortunately.

Must be direct lineage for status to pass (child, grandchild) ROFR or to either skip or have automatic waiver of ROFR. Also, sometimes it comes up in this situation about either having a side deal or trying to structure an unmatchable situation to bypass ROFR. My understanding is anything that's part of the deal, even with a wink and nod, that's not included in the contract is illegal when ROFR is involved. And there are an examples where timeshare with ROFR required a dollar value for purposes of ROFR when unique items were involved.

Not for full transfer, but you can add their name onto the ownership and it will be OK.

And so just to make what should be simple more complex:
A direct gift to a nephew does not work
A gift to a parent who then gifts to the nephew will work if the nephew is also the parents grandchild
 
I assume a sibling is the nephew's parent. You can transfer to a sibling. Who can transfer to their child your nephew. I know ot takes time and effort but it can be done with that extra step.
 
What if one placed the timeshare in a Trust and let the extended family use it. Would there be a finite end to this arrangement? Could the trust be structured to include a nephew as a beneficiary?

Despite being held in a trust, I believe the ownership needs to be attached to one or two specific individuals, and they are treated as the effective owners. But they should be able to make reservations and then put the nephew's name on the reservation, if desired.
 
I have both Marriott and Vistana units held in one family trust
All trust members are either my spouse, my children , or their spouses
Marriott has never put a limit on my trust on the number of trustees or beneficiaries or their trust use
Some of the ownerships are enrolled , some are not
My understanding is that if I added a non eligible person to the Trust the enrolled weeks would no longer qualify to be enrolled
I do not think the number of Trust members matters just their proper familial relationships
Note:
I am a fan of using a trust for your ownership(s)
That said as a practical matter a trust complicates your day to day use and the more people in the trust the worse it gets

What about a LLC? We've been thinking of setting up an LLC to own/manage our units. Would the rules be the same as trust or not allowed?

That would do it, but I'm wondering if Marriott requires that. I have a nephew that I'd like to gift a unit to. In theory, I could gift to my brother who could then transfer to his son. We share the same last name.
