[ 2018 ] rescinding bluegreen!

So thankful I found this website! We (stupidly) bought a bluegreen timeshare this past Saturday (10/30/2021), and by midnight that night were googling and regretting our decision. We ended up following OPs template and typing up a letter of rescission which we got notarized and sent out on Monday (11/1/2021) via priority mail express (i.e. overnighted) with signature required and return receipt. It is now Thursday (11/3/2021), and my tracking information says it's still in transit and hasn't even made it to Florida yet. I know all the previous posts says it just needs to be postmarked within the 15 day rescission period, and I have my USPS receipt, but I'm still freaking out that its going to get lost in the mail and not actually make it there. I also feel like I should call them to notify them of the incoming letter, but I also know in the past, you've said not to call.... Any advice or reassurance would be greatly appreciated!



PLEASE STOP WORRYING. Sadly, your rescission mail may get lost and not show up for a couple of weeks. It doesn't matter at all. In fact it really didn't matter that you notarized it. Not sure why you did that (first I've heard a rescission letter being notarized).

What really matters is the actual Postmarked date you mailed it (was it within the required date) and that you mailed it via "tracking". It does appear you mailed it within the correct time span, and it does appear that you can track it. I am not sure of where you thought you had 15 days to do so as that is likely a far too long rescission period. HOWEVER, you did it within 3 days so you are just fine!


Basically, sit back, relax, celebrate and have a drink! :cheer::banana::hi::wave:


You made a good move to rescind. Note that you may not receive a refund for up to 45 days.

I would say business day means M-F and not Saturday and Sunday.

I hope you are successful in rescinding. It's so important to not pay the high prices they charge at the sales' table.

NC law:
North Carolina provides five calendar days to cancel a timeshare agreement after you sign the contract. You may not waive the right of cancellation. Any oral or written declaration or instrument that purports to waive the right of cancellation is void (N.C. Gen. Stat. § 93A-45)

Usually if the 5th day is Sunday then you can get it in on Monday but if Sunday is not the final day it counts.

Just thought I'd post again and share that it worked; I've received my refund! We signed paperwork on 11/12 and my contract was done at Christmas Mountain, WI but it said "North Carolina - 5 days". I sent in a certified letter on 11/19, not knowing if that was actually my 5th or 6th day (do Saturday's count?) and I wasn't sure if it was business days vs. regular. Anyway, on 11/24 I received a refund of $45 for my "orientation" that was supposed to be scheduled and today (11/29), my full amount of $18K is posted as a credit.

I really want (and still want!) Bluegreen to work out, but after researching on several Facebook groups, I realized that several things had been exaggerated to me. A large part of my plan was also to use that Bonus Time for $59-$99 rooms to save my points and finding out that you can't book that until 45 days out and it usually has limited availability was a HUGE red flag for me.

I also didn't realize it was so easy to buy points through resale and if I don't need those "charter" benefits (aka Bonus Time), then I don't have to go directly through BG.

Anyway... just wanted to share! It's worth the $3 in certified mail costs to try, even if you might be close to (or possibly over) the cancellation date.

You still get bonus time with resale but only at the resort where the resale is located. So if you think you want to travel when bonus time would be available (I wouldn't count on it during prime season) then pay attention to where the resale contract is located.

I reserved a "villa" at the Fountains in Orlando and was encouraged to attend a new owner's update ... ostensibly an hour for which I would receive a $100 voucher. The rules of BG benefits are very complicated and I had a lot of questions. That "hour" turned into an all-day high-pressure pitch that I had not experienced before with BG. My BG home is in Branson MO and enjoyed that wholesome environment. Boy, what a difference from the midwest values to the Florida hustle!
I hope you didn't give into that! All day? I think it would make me crazy, I would be yelling for them to let me out of there. $100 is not enough money to spend even two hours! So you signed the contract? Talk about DURESS!

Hi all, new here.

I got suckered into the 4000 points plan for $11,000 with $200 down after 300% equity offered to me from a sampler purchased in Nov 2021. Also was offered 2 RCI weeks, a 7 night cruise, 1/2 year of maintenance/club fees waived and 1 free year of Traveler's Plus/Chartered Benefits, plus extra 4000 points in year 2, the 9000 sampler points rolled into the first year (and lift restrictions on the sampler points). All this sounded great until my partner pointed out that all these extras are used up by year 3-4, and year 5 you start to feel the burn of having only 4000 points and $810 annual maintenance/club dues. They made it sound easy to sell your plan, and also when I told them I will inherit my parents' Interval International timeshare, they said they can easily buy that from me/rent it out for me. However I am seeing on this forum that it is not that easy and I will end up losing money.
After finding this forum, I am shipping the rescind letter today with a separate media mail package with all their stuff (book, certificates, etc....also the wristbands and the promo bag (I should return that right?))

My question: does cancelling the ownership (4000 point plan) mean that I forfeit the sampler too? I called the new owner dept and they said the contracts are totally separate...and then when I specifically asked my question about cancelling ownership affecting the sampler, she suddenly "wasn't sure" (even though this is the corporate office!) and needs the Shenandoah Crossing in VA sales team to call me to follow-up "since that's where I bought it". I assume this is to convince me not to cancel...she even mentioned "you have 7 days postmarked from time of signing"...

So maybe you guys have the answer for me. I would love to use the sampler, and would be happy to keep it. I paid $895 for 9000 points that have to be used this year. And now I know to avoid the meetings and/or stay firm with NO.
What happens if they say I have to forfeit the sampler b/c i cancelled the ownership? then that means I lose $895 and 9000 points that I didnt get a chance to use....

also here's an observation:
the MPOS and bunch of other documents was on CD-ROM, they had me sign that I am ok receiving documents on CD rom, but then as I'm walking out I realize it's not in the bag of stuff, I point it out, they act all confused...someone asks someone who says "we are out of stock of the CD ROMS" and that "it will be mailed" to me. Later, i find out in the fine print that you should not sign for the CD rom vs printed documents "unless you can view the CD ROM within the cancellation period"....so I'm guessing there is some important information on those MPOS documents....anyone know anything about this?

I'm submitting my cancellation anyway (have until 1/13 midnight postmarked), but what is with that?

PS Bluegreen resorts so far are nice, no complaints there. I would be happy to buy resale points and go...I met people who found weeks on Airbnb and Craigslist (of all places!).

@NotABaller, I think you should just get the rescission in the (Certified) mail and let the chips fall where they do as far as the Sampler package.

Ok so I send the letter out with a copy of the deed but I didn’t send the rest like other paper work or the books they gave me is that going to be a problem ??? They also gave me Sutton gift like flight gifts to a destination but now able to use it after six months paying with them which I haven’t even started sighed in the 30th of jan and send the letter on the 31 next day shipping plz let me know if I did this wrong anyone plz help me !!!!

Make sure you send USPS certified. Follow rescission instructions as exact. Also, make sure whoever signed the contract also signed the rescission letter, and clearly state your intention to cancel.

You will never get an acknowledgement (response) of your rescission, however, they do have to act on it by law, and you will receive a refund within 45 days only on the assumption that it was POSTMARKED within the required time frame. That time frame differs depending on what State the transaction occurred in.

Using USPS Certified Mail you will be able to track your rescission and you will know in fact that they actually received it.

Remember, you can not cancel your ownership, however you can rescind your ownership IF you rescind within the time frame legally allowed by law.

The 45 days for a refund/cancellation seems to be a moving target. My recission took 75 days to complete. I called them to see what was going on, lady said the contract was cancelled and the refund was being sent out (I paid by check). Lo and behold a couple days later it came. Never did get the 45 dollar deposit for the owners weekend back. I figured that was stupid tax on my part and just let it go.

Hi. Thank you so much for this thread!

My wife and I foolishly purchased a timeshare with Bluegreen Vacations while on a trip to Las Vegas on July 9, 2022. We are kicking ourselves at how badly we messed up here. Fortunately, the state of Nevada requires that purchasers be given a hard copy of the public offering statement that includes a 'Time-Share Notice of Cancellation' letter which we found in our owners bag later that night and we did locate the portion of our contract that included the instructions for our right to rescind by written notice the contract of sale until midnight of the fifth calendar day following the date of execution of the contract.

In addition to the provided letter we also crafted an additional letter that was based off the template provided by the OP of this thread and provided a copy of the signature page that includes the cancellation clause. In short, we have sent three separate notices that we are exercising our right to rescind to the address provided in the cancellation portion of the contract. The first was sent by certified mail with a return receipt via UPS on July 11th. The second was sent by certified mail with a return receipt via USPS and included the postmark stamp on the receipt on July 12th. The third was sent by Priority Mail Express 1-Day also sent on July 12th and is expected to arrive on July 13th. We have kept all receipts and tracking numbers.

I do have a real concern about what is on the CD-ROM and if there is an important piece that I am missing. I have not been able to access a device that will read it and honestly where does one even find a CD-ROM player anymore.

I know that the postmark on the USPS Certified Mail with a return receipt submitted during the rescission period puts us in the best spot to undo this mess.

Does anyone have any advice about additional steps I could take before the rescission period passes?

I am terrible at the waiting game and my emotions are all over the place right now. At this point, any feedback is appreciated.
