Will Marriott ding your credit for failure to pay MF/Foreclosure?? Title issue discovered during "deed back" attempt.

We have 2 weeks with Marriott Desert Springs Villas. One is points and one is deeded. We purchased them 15+ years ago through a broker who is long out of business along with the title company. They do NOT have loans and are paid off. I lost my job due to medical retirement, can't afford $4500+ MF etc.

Unfortunately, the TS's gotta go. We tried to deed them back to Marriott a little while back, but they said one of them has a "title transfer issue" see below:


We paid the 2024 MF hoping things would get better...they did not.

I have not paid 2025 MF fees as I do not have the money. Will Marriott report to the credit agency and lower our credit? What does Marriott do if we continue to not pay the MF?

What season are these? Red or Platinum (winter-spring?) They have resale value. You can give them away here on TUG as well.

Not going to be able to do either if title is clouded.
 
The OP should really reach out to LT Transfers. They may be able to provide some advice but may not be able to directly help fix the problem. Perhaps they could but depending on the actual title issue it might require quiet title and that is something either an attorney or licensed closing agent would need to be involved with.
 
I agree. My guess is some sort of defective deed issue vs. no deed at all. MVC must have seen a recorded deed of some type to transfer ownership on its books. There was another thread about a similar issue. MVC does not do a title search or even a rudimentary comparison of prior deed to current deed, IFIRC. If they deed is defective, they should demand that MVC remove them from the HOA's ownership rolls, as they are not entitled to be a member, and HOA cannot bill them. If they refuse, an attorney could easily sway them, as the HOA is 100% in the wrong if they do not own.
MVC's own closing department transferred a defective deed to us. I believe incompetence is at issue rather than foul play. I suspect in the very near future they are going to wish they had placed more value on hiring competent in-house legal staff.
 
I wouldn’t want to pay to have the title fixed just to have exit services for the third time. Tell me that they won’t work with me, and have it go to foreclosure anyway
Please update us on how this turns out. Deed issues are among many irregularities others are paying attention to with respect to MVW.

This email serves as confirmation that the process to transfer your ownership with Marriott's Desert Springs Villas described as ********** was terminated. First American Title Company performed a title search and determined you are no longer the owner of this week. A Quit Claim was signed on 3/14/17. However, the new owners never contacted MVWC to update the records.

So apparently back in 2017 someone quitclaim'ed out unit without our knowledge. Marriott has been receiving our maintenance payments and county taxes during that time, but apparently we did not even own the unit... It looks like we got what we wanted on that unit, but it does not seem right that we have been paying for something we did not even own.

Is there any recourse?

If you wanted to get rid of it anyway this is a good outcome. It sounds like you were the legal owner before 2017. I'd still see if you can get a copy of the deed if that's the case to see who/what happened. My bigger concern would be that if it were identity theft you may have additional issues to worry about that are more important. .

So you didn't own, it but were using it year to year? I doubt there is any recourse if you actually used it.
 
Glad you got out without any issues. It's a good thing when Marirott takes back a timeshare you don't actually own. 🤕

Not against MVC certainly but possibly against others. Not that it'd be worth fooling with unless it was someone inside their family or that that stole their identity in which case I'd at least file a police report. It sounds like this happened after they owned it but if it was around the time they bought it, it might have been the previous owners. They could have even had multiple weeks and it got messed up in a transfer or they could have tried to sell it more than once on purpose. Regardless I'd be nervous about other potential issues beyond this timeshare. I'd want to look at all deeds to se who and when and that would direct how much effort and worry to devote to this issue.
