Update: Sent in the rescission letter and did everything right but USPS messed up...now what?

Just wanted to provide an update in case this will be helpful in the future for others.

Recap: I sent certified mail with return receipt request but USPS did not obtain the return receipt portion which caused me anxiety thinking they'd act like they never received it although the certified mail did confirm someone received the package...


I funally called their customer service today to check on the status of the refund (I called their Loan line and they connected me to the resolution team)

Their agent said typically once the Rescission department receives the letter, they will add a notation to the account that the client has cancelled. The first agent told me there were no such notation and transferred me over to resolution team.

They were straight forward to assist me with the issue. They double checked again that there was no notation of cancellation. The resolution rep asked me to email all my documents and proof of postage. I sent in the photo of the certified mail with stamp with photos of the documents I sent. He is elevating the issue for me so just waiting to hear from him. I'll update as soon as I hear back.

You have done everything correctly.

Keep track of everything you are doing (i.e. make copies of everything you're sending) and mail an extra copy tomorrow to the Consumer Protection Office at the Atty. General's office in the state in which you reside. Remember, it is they who enforce the rescission law in your state. Send it via USPS Certified Mail.

It may take a month or two to straighten things out but you will be fine if (assuming you saved your original Postal Receipt). Once the state gets involved your resolution will likely happen sooner (the Developer does not want the state involved in it's business at all).

I was hesitating to contact them at all so time has passed and I finally called much later than that. They explained to me that normally once they receive the letter they will put a note in the system within 4 to 5 days that client has sent in a cancellation. In my case, there was no note.

I didn't get to their resolution line directly but I called their loan services that's listed on their website first and they were able to patch me through. The reps were straightforward. No one was trying to upsell me or try to talk me to keep it. I was not sure what happened with the package I sent but as long as you have the postmark date then you are good and they helped you with no problem!

I sent it via certified and it did show as delivered. Based on this experience it seems like that was enough proof (I took a picture of that slip I filled out with the postal date and sent to the rep when they requested it.) The part that stressed me out was I also sent it with return receipt request (which costs extra with USPS) and they did not complete that part so I was concerned about it. The tracking for the return receipt never updated so it seemed like they did not complete that part of the service.

Yeah, I think that happens fairly often. It is a manual step for the postal carrier to have that signed and drop it back into circulation. If they are dropping a bunch of certified mail it may not even be seen when they are delivering all the envelopes.

I agree with you. Someone mailed me a letter that required a signature. My neighborhood has a community mailbox. The mailman drove past my house to get to the community mailbox and left a note in my box that I was unavailable for signature and that they will attempt the next day. I complained to the post office via email that same day. The next day, the letter that required a signature was just left in my mailbox.
