Template for sell a timeshare

Hello, I'm looking to sell my timeshare and I'm wondering if anyone knows of a good template or sample agreement that I could use for the sale. If anyone has any suggestions or resources they could share, I would really appreciate it.

not sure a generic form would be all that helpful as the process and laws for the transfer of a piece of real estate varies from state to state, so whatever state and county the timeshare exists in will have its own unique requirements for how that transfer is handled and recorded.

of course if you are familiar with said process in that state/county (and local to it) you can absolutely do much of the paperwork yourself and save some money. That is not usually the case and the majority of owners simply hire a closing company to take care of all that paperwork on their behalf.

Yes! Follow the previous advice and go with LT Transfers. If I was buying another week, I wouldn't use anyone else. If I was selling my week, I wouldn't use anyone else.
 
Are you referring to the deed or the purchase agreement? If the deed then I agree that LT Transfers or some other service should prepare that for you. As @TUGBrian said, deeds are state-specific and also have a number of “magic” terms so it’s best to let the professionals handle that part. If you’re referring to the purchase agreement, there are a number of template agreements out there if you’ll Google “timeshare purchase contract” or similar. I’ve prepared my own agreements for transactions where I had control over that piece. They are generally fairly simple because timeshare transactions are generally pretty simple. PM me and I can give you more color.

The link you provided is for a bill of sale. That’s not a document you’ll want to use with a timeshare sale. If the ownership you are selling is deeded, you will need a deed, which, per the above discussion, should be handled by a professional. If the ownership is a right to use or membership, the timeshare management will have their own transfer form or assignment agreement and you won’t need your own. A bill of sale is also not a purchase agreement, which is something I highly recommend you have, so the terms of your sale are clear, agreed and enforceable.

A bill of sale is generally used to document the sale of personal property (as distinguished from real property, which deeded timeshares are), such as cars, furniture, etc.

The link you provided is for a bill of sale. That’s not a document you’ll want to use with a timeshare sale.

I think at this point it's safe to assume the OP doesn't want the actual answer. He or she is looking for something which looks legitimate. Not a solution which actually is legitimate. Probably running some sort of "relieve you of your timeshare" scam.

"Look! I have this official, signed, notarized bill of sale. Just send me $5000 and you are finished with your timeshare forever!"
 
A quit claim deed form can be downloaded or obtained at many places including a County records department in many areas. They are a fast and easy way to transfer ownership of any deeded property including deeded timeshares.

If the timeshare is a membership all you need is an ownership transfer form from the resort.

If a person hasn't ever been through a transfer they may want to use a transfer company. Sometimes the peace of mind obtained by letting a pro do something like this is worth the costs, imo.

Laws vary from state to state. Also, timeshare interests vary from timeshare to timeshare. If you interest is deeded as most are in the US, your contract will need to meet the requirements for a contract to sell real estate in the state where the timeshare is located. In most, if not all, states, there are standard forms for this approved by that states Bar Association and / or its Board of Realtors. Using one of those from the state where the timeshare is located should help in getting a valid contract. Of course, people can still sometimes screw up on how they fill it out.

Some states, like North Carolina, require that contracts and deeds for the sale of an interest in real property be prepared by attorneys licensed in that state. Reputable multi-state timeshare closing companies retain local counsel where the law requires it. The firm mentioned above is run by an attorney, so I strongly suspect, they would make sure they comply with such local requirements but I am not familiar enough with them to absolutely state that as a fact. To be certain, it would not hurt to ask that question.

Some of the timeshare closing firms run by non-attorneys have had a tendency to play fast and loose with legal requirements, but I would have a higher degree of confidence in a closing firm run by an attorney.

Sometimes, checking with the office of the timeshare involved may find you a good source of help. Some HOA's have their own attorneys who will help with closing at a discount price.
