Postcard companies: How the transfer takes place between original owner and new buyer

The difference between the developer (selling at a huge price difference between them and resale) and the postcard companies is that almost everyone is aware of the developer and that they will be trying to sell you and ask alot of money. The postcard companies tell you they will be making you an offer on your TS. Only when you get there do you find that they want you to pay. They also tell many other lies ( we don't sell them, you can deduct the loss, your kids will be stuck with yor TS) but the biggest is they say if you pay them they will take your TS from you. This implies that they will be taking ownership but they don't. They take power of attorney, so they don't ever have to have the TS in their names. and therefore your still risking that they might not ever transfer the title from you.
 
Why is the Department of Real Estate not closing them down? They are in the business if they sell more than 5 properties per year and the same is true for a private individual so they need a real estate license. I am almost sure it is 5 sales only in CA. Is this different for every state?
 
Thay don't buy or sell. They take your property by using the power of attorney and sell it. Offically they aren't the seller or buyer or realitor. Just someone you paid to handle the transaction for you.
 
Something is weird with this thread. I am unable to see some of the last posts.

Emmy, this group of conmen goes around all real estate laws. They are not Realtors or brokers at all. They take the weeks and transfer them from seller, to themselves (Thomas Ochoa transfers to his name first, then to new buyer, but Vacation Solutions transfers to the company name, then to new buyer). They don't have to abide by any rules and don't need licensing. It is criminal, but they get by with it.

The product they sell is great. It is not a scam to the person who buys the product, but the person who paid to get rid of that timeshare did get scammed, that is for sure. But there is no crime in anything they do. I think it should be illegal to tell people how bad timeshare is and then sell the same product on eBay with the exact opposite information. That is talking out of two sides of your mouth and is not at all ethical. :rolleyes: But it isn't illegal.

You are right as they ask for a power of attorney. Don't they have a business license either? Aren't they regulated too somehow? The older or ignorant folks pay them big money and believe that they are off the hook for paying more fees but they aren't unless it transferred to the new buyer. I wouldn't want part of this deal in any way and certainly not work for such a company. I hope people get wised up real soon. TUG is trying. :)

Imho, you cannot compare this with overpriced developer sales as it is like buying a new car. You drive out of the show room and your car is worth half of what you just paid. It is your choice to buy or not to buy but these poor souls are ripped off and don't even know it. With developer sales, you have time to read the fine print of the contract and search the internet for more information. It's out there in the open if you care to look.
