How to Cancel a New Bluegreen Timeshare Purchase

I wish there was an edit button. To add to the above, we sent the rescission letter already via priority mail express and is guaranteed to be delivered 10/17/24 by 6pm.

Sorry but this is me just being paranoid. I'm a little confused about the statement below, which appears at the end of our contract:

'Notify' shall mean that a written notice of cancellation is delivered by any means, which may include certified mail, return receipt requested, to Bluegreen Vacations Unlimited, Inc. It is a violation of F.S. Ch. 721 for any person to interfere with the delivery of a notice of cancellation by a purchaser.

Is this saying that our rescission letter is required to be sent via certified mail, return receipt requested? Or is it simply saying that's acceptable, and that I shouldn't worry because priority mail express (overnight) still tracks delivery? Paranoia was triggered by the following Google search result from nolo:

"Some timeshare companies allow hand-delivery of a cancellation notice. Others accept delivery only via registered or certified mail. Be sure to follow the instructions exactly and make sure the letter is delivered within the applicable rescission period. Otherwise, your cancellation might not count."

Would it make sense to send a duplicate letter via certified? For redundancy? Once again, sorry. Totally new at this and I don't wanna mess this up. We signed on October 10th so we're still in the Michigan 9 business day cancelation period.

Could you take a screen shot or scan of that verbiage from your actual contract and post it here so we can have it officially on this thread.

I have never heard of 9 business days to rescind but I know it is state specific.

As long as it is within the prescribed time to rescind the mailing date is all that counts and you have a receipt for that.

Please see my request in post #27 to see a screenshot of your contract that states 9 business days

I just checked @dioxide45 list in post #12 and it confirms 9 business days Such a random number !

If it's going to make you sleep better then you should send it again and don't worry about spending the money for it. After all, you will be saving yourself THOUSANDS OF DOLLARS over the next ten years!

Final update: The $49 refund for our orientation stay hit my bank account today. The $1000 portion of the deposit that was financed on the Bluegreen/Barclay's card also showed up, along with the remaining $774.20 that my wife paid on her debit card. So glad we're done with that!

Do it within the legally allowed timeframe. Send it via USPS Certified Mail. Retain a copy of your paperwork as well as the dated Postal receipt.

As a back up you can also send it via email as well as a first class letter with a USPS Certificate of Mailing.

Smart move to rescind! How much money will you end up saving?

What property and state? Nevada has a form included in your paperwork to send in for the rescission. Most other states, you just need to write up a letter yourself, sign it and send it. Most important, follow the instructions in the contract.

Just called after I sent in my rescission letter and they tried to tell me I also needed to send in all of the original paperwork and booklets. It does not say that anywhere in the contract that I need to return any of that. Hoping no more issues with this!

If you called the sales center they will do anything they can to stop you from canceling or make you think you did it wrong.

Ignore them; you stated above you filled out the form and sent it in within the time frame and you have proof of when you mailed it. You don't have to send anything back.
