How to Cancel a New Bluegreen Timeshare Purchase

Posting this as a sticky for the forum in hopes more owners will find it in time!

Here is a link showing the cancellation section of a current Bluegreen Timeshare Sales Contract, this section or something like it will be in YOUR sales contract as well so do your best to find it to ensure the instructions have not changed! (note that in many cases the rescission period can indeed vary depending on the state you bought in and might not always be the 10/15 days mentioned in the contract here:

this also includes the option to rescind via email to: BGTN.services@bluegreenvacations.com (note we ALSO suggest sending it via regular mail to the address listed here OR in your contract and retaining the receipt as proof, cant be too careful and why risk it for the cost of a certified letter!)

This is the first time I have seen the 10/15 day stipulation. Do we know what state this is? It seems if you bought on site you have 10 days but if you bought off site you have 15?

If they were in Tennessee when they signed, it is based on TN law and the contract indicates it is based on TN laws.

They are not better.
We now have info for Tennessee and Florida.

Many people buy In Missouri because of the affiliation with Johnny Morris and the Bass Pro Shop.


We are hoping to list different states requirements to rescind.

Nolo seems to have a good list of the different rescission laws by state;
 
Interesting, so it is not BG specific or Marriott specific - but rather state.
That is certainly something we can post as a sticky here.
Correct. Timeshare rescission laws are based on the state or country.
 
I just got another confirmation that a person rescinded via email in Tennessee so apparently it DOES work.

New member was able to cancel / rescind a Sampler Package.

New member @anna_bish provided the verbiage for rescinding in Georgia. It is 7 days by mail.

”This is how the contract reads: " you may cancel without penalty of obligation this sales agreement for the purchase of a lease of a timeshare interval within seven (7) days, Sundays and holidays excepted, after signing and receive a refund of any funds paid. If you did not receive a public offering statement prior to signing this sales agreement, you may cancel this sales agreement within seven (7) days, Sundays and holidays excepted, after receipt of a public offering statement. You may not give up or waive this right to cancel. if you deice to cancel, you must notify the developer in writing within the cancellation period of your intent to cancel by sending notice by certifed mail, return receipt requested, To: blue green vacations unlimited, INc. ATTN: corporate sales accounting dept., 4960 conference way N STE 100, Boca Raton FL 33431-3311. You notice will be effective upon the date you send it."
 
Bluegreens in Wisconsin is 5 business days.

My wife and I just sent a rescission letter to Bluegreen. She wanted it to get there ASAP so we went with priority express (overnight). Is that ok, or is certified mail required?

The way you sent it is fine because it does have a verifiable tracking number and an official United States Postmark from the USPS.

By the way, it really doesn't matter WHEN it arrives, but it does matter WHEN it was Postmarked. As long as it was Postmarked prior to your particular rescission deadline then the rescission laws apply.

Congratulations on rescinding. Now go out and buy resale after you get done celebrating!

I don't have it in front of me, but at least $15k. And thanks. After a few days of thinking about it, we decided it just wasn't going to work. Probably can't even afford resale at the moment, but will definitely look into that when the time comes!

As long as you have proof of when it was mailed ( keep your receipt) you are fine.

Sorry but this is me just being paranoid. I'm a little confused about the statement below, which appears at the end of our contract:

'Notify' shall mean that a written notice of cancellation is delivered by any means, which may include certified mail, return receipt requested, to Bluegreen Vacations Unlimited, Inc. It is a violation of F.S. Ch. 721 for any person to interfere with the delivery of a notice of cancellation by a purchaser.

Is this saying that our rescission letter is required to be sent via certified mail, return receipt requested? Or is it simply saying that's acceptable, and that I shouldn't worry because priority mail express (overnight) still tracks delivery? Paranoia was triggered by the following Google search result from nolo:

"Some timeshare companies allow hand-delivery of a cancellation notice. Others accept delivery only via registered or certified mail. Be sure to follow the instructions exactly and make sure the letter is delivered within the applicable rescission period. Otherwise, your cancellation might not count."

Would it make sense to send a duplicate letter via certified? For redundancy? Once again, sorry. Totally new at this and I don't wanna mess this up. We signed on October 10th so we're still in the Michigan 9 business day cancelation period.
