Ok Here Is The Deal...
... that worked for me.
I called UMS to ask them to close my account. Gave them my name and ad#. I was put on hold and when they came back, they told me they had someone but still checking credit. I was like, "ok, great, I don't want to close." I waited a day. I called again. Same thing happened, but this time, I called them at their own game. After the lady told me they had someone, I told her, "You just commited fraud!" "What?" "You just commited fraud, there is nobody in credit check." She turned away from phone and said to someone, "he said I commited fraud." Another person came on. I recognized her as being a major player from the Other Thread I mentioned before. She tried to explain that they check the Buyers to get a down payment and there are lots of Timeshares to choose from. I informed her that the person before her check MY AD# and she told me they wanted MY timeshare. I went on to explain that according to the Contract, item #2 says that they will forward all inquiries to the Owner. This person in credit hold, you did not forward their inquiry to me. That is a breach of contract. I told her that on 4 seperate occasions, one being yesterday, you breached the contract by not forwarding the inquiries to me. ( I had a note of the times I had called in the past, but I fudged the dates, not remembering the exact day, but I wrote it down on my paper before I called) Yep, on Aug 8 2008 @ 11am, I called and Sept 11, @ 9:15...etc... Each time I was told they had someone interested. She went on to explain how I would get my fees when TM was sold. I explained, after the 120 days, you have no incentive to sell (but I was only in it for rent). "And while we are on this call, I want to close my account." "That is fine, we can stop working to get you a buyer." she said. Fine... close it. She said she would. "Ok, good, now that you closed it, I want my fees refunded, item #3 says it will be refunded 'upon closing'" "No, that means when the deal is done" she responded. "No, close means close. It doesn't say here that it means 'closing a deal', that is what you say it means."
Well, the conversation ended with her saying that I can do whatever I want to try to get those fees refunded. Now, I have to make note that during our conversation, she brought up the Other Thread and how that ex-employee was mad and I shouldn't believe a word he says. But I pointed out that Joanne, a representive of UMS, also said on that Other Thread that UMS would refund the fees without anybody having to threaten to go to the Attorney General. "So, I shouldn't believe what Joanne said about refund if upset?"
About a minute after hanging up, I got a call from another major player, also recognized name from the ex-employee Other Thread. Although when I asked him for his name, he gave me a different last name than what it really was. He calls and explains how item #3 means closing the deal...blah blah and how about half my fees being refunded. "No, I am not happy with that." He says, "I will send you a check overnight for half and that is end of story." Hung up.
About another minute later, he calls back... "Ok, out of the goodness of my heart, we will send a check for the full refund." Hung up.
I called back. (this is when I find out he gave me the wrong name) I thought, this is another scam. Tell me they send check & I wait forever. I get Mr Manager back on phone. "Why can't you credit back my Credit Card? I asked.
He got upset. "I told you we will refund it, now don't be calling me back about this. I am being nice!" Hang up!
Man, was I shocked to see a FedEx truck deliver me that check the next day.
One more thing I neglected here. On the second day before I actually called in to claim FRAUD. I did call their Attorney. I told him that I had 3 cases of breach of contract, (he is the person that wrote the contract) one being as early as yesterday and that I would like to talk to him about it. Left my name & number. Then I called UMS. I don't know if the Attorney call helped my case or not. When they told me the lie, that was #4.
I encourage anyone that wants out of Universal Marketing Solutions to employ this tatic, it worked for me.
Oh yeah, and I used a telephone number that went to a live person and is not their normal Customer Service line that usually goes to voicemail. I did catch them off gaurd. I will enable my Email for Members or Admin to contact me if you want that phone number or want any other assistance..
One last thing... the one person told me to send a Certified Letter to their Owner, Jennifer Kirk, saying the timeshare didn't sell as expected and I can't recall if the letter should say that I would contact the Attorney General or not, but if I sent the letter, then I would get a refund. Since I can't recall exactly, that is why I am not saying you have to do that. But I was about to write that letter before they called back. I can also provide you some info if above tatic doesn't seem to work and you feel that you have to threaten them with a lawsuit or whatever.
