Ebay Buyer with Cold Feet..Paid but now wants to renege

Like I said before- threaten to out her to her husband if she doesn't follow through. That seems to be the one thing that she is afraid of.:wall:

How do you dispute fees with Ebay. I tried and they said I had to pay even though the units never sold. I got one free re-listing but that's it.

Closing= $300 to the escrow company to close the contract
RHC=$500 transfer fees to the RHC

I have written to the buyer to try to get her off the dime but she refuses to answer me. I wonder if she is waiting to be repaid on her cc.

Why would you even mention the $500 at this point? You haven't paid it, correct? I don't see why you are stating 'taking a loss' on a fee that you haven't paid.

Anyway, here is the link for an unpaid item... There is one choice that states that the seller and the buyer mutually agree to cancel. Tell the buyer that once she agrees to that, you'll refund her money. I think you have a 45 day window from the winning bid, so I hope you're not too late. Also, there still is a listing fee, but you get the eBay commission back... which would be next to nothing on this transaction.

Actually it's both

As I understand, the reason eBay real estate auctions are not binding isn't because of Statute of Frauds; it's because by taking a commission on a transaction between buyer and seller eBay legally would become a real estate broker, requiring that they become licensed as brokers in all 50 states and carry all of the duties in the transaction of a real estate broker. Then there are all of the other issues that might attend to being involved with real estate transactions on an international basis.

Yea, the real estate licensing people play a role in this. But, Statute of Frauds are defininitely a problem depending on what the statutes say. In California (copied directly by Arizona in the 70's), for an example, Marylyn's entire transaction would be void, which is just another reason most of us here, regardless of all the side issues, feel she is just fine and needs to do nothing. Numerous states in the East and Southeast that have old property laws still on the books would result in the same outcome. Clubs and points secured by real property are presumed covered by the statute, unless of course there is an exemption.

To further complicate things I am reading on the points board that RHC is enforcing an assessment fee due in November, based on high energy costs, blah blah bah. That will have to be paid, too. I have not gotten my letter/fee increase yet.

This is a perfect example of damages that the OP has (or will have) suffered as a result of the bidder backing out.

Has she not sent one dime, I'd be on her side but the face that she did send money puts me on the OP's side.

What is the status of this transaction?

Have you decided not to pursue the buyer at this point?

Hopefully, another buyer may make you an offer.

The original buyer has backed out. Basically the original buyer left her money on the table and walked away, all because she didn't want her husband to find out.

I found another buyer to take over the contract. All she will have to pay is the amount that the closing company is charging to write a new contract, $150. I will continue to pay $400, the closing company and RHC for fees. The original buyer paid $250 and the new buyer pays $150 for a total of $800.

I imagine if there is a special assessment the new buyer will take care of that as well since I will not be able to take the free vacation associated with the assessment. I understand the amount of assessment will be $170.
