What happens if I don't pay the maintenance fees

I want to get rid of my HGVC timeshare. The maintenance fees+club dues is $1300 and the deadline to pay it is 31 Dec 2023. I have already listed it for resale through the HGVC resale department.

Has anyone tried to get out of the timeshare by not paying the maintenace fees for some years when it goes to default? I am considering this route. Anyone have experience with this route, please let me know.

Well, you can't sell it if there's MFs owed. Have you listed it in the giveaway section of this forum?

Just my two cents....

(1) I suggest that you stay current and pay your 2024 MF since we're already at the end of December.

(2) When you reached out to HGVC did you indicate that you wanted money for it (sell) or give it back to them to them for free?
Folks have recently indicated that HGVC has taken back some weeks. The following was posted recently (link).​
  • "If anyone is interested in contacting HGVC about a surrender, the contact email is pfoliosvc@hgvc.com."

(3) If HGVC's surrender program is unsuccessful, then follow the advice under the TUG giveaway forum regarding the basic information that should be provided in your giveaway post.
It's a buyer's market. Potential buyers will simply skip over and wait for the next one if the ad is not straightforward (leaving too many unanswered questions and/or requiring work on the buyer to figure stuff out).​
Also list the benefits of HGVC ownership that a potential buyer may not know.​
  1. Club Dues currently includes RCI Membership (including access to RCI's cash rentals) and access to Club Benefits such as Open Season Cash Rental Rates at Legacy HGVC Resorts (30 days before check-in).
  2. Your week can be traded within HGVC using points to book any legacy HGVC resorts (for any room size/type, any season, any check-in date, 3-night minimum at most). And indicate the HGVC resorts that can be book for a week with 5440 points. For example, a HGVC studio and/or one bedroom in Vegas, Oahu, Big Island, Orlando, Carlsbad, South Carolina, Chicago etc.
(4) Walking away should be your absolute last option. Here's what has been shared.

I was not aware that HGVC had a resale department where one can sell units that an owner owns. I thought that the resale department just sold HGVC owned units. Please let us know more about this resale department for owner owned units.

I was not aware that HGVC had a resale department where one can sell units that an owner owns. I thought that the resale department just sold HGVC owned units. Please let us know more about this resale department for owner owned units.

If they are not interested in buying back, they will direct you to one of their 3rd party brokers such as Judi mentioned in this thread.
It's been previously reported that HGVC gets some of the commission for the referral and the rest goes to the resale broker.

That is just a come on for owners who want to sell their units. HGVC is not going to take back most of the units that owners want to get rid of and resell them. As other have said they might take back some NYC units and perhaps some penthouse units in Honolulu but not most of the units that owners want to sell so that HGVC Timeshare Associations are not burdened with unpaid maintenance fees.

I am not sure if your question is differenciating between HGVC and HGV which my statement was not meant to differentiate. My question was about having a place for owners who no longer want to use their timeshare units and pay their maintenance can unload that burden to HGVC or HGV.

The goal is helping unit owners who no longer want to use their timeshare units and pay their maintenance. Rather than an owner becoming delinquent on their maintenance and become a burden to other owners of the timeshare property they own have HGVC take the unit back and resell it.

I am an owner of a Condo now which has alerted me to the fact that one of the issues that Condos have is delinquent owners who do not pay their maintenance so the other owners must pay the delinquent owners share with higher maintenance fees.
 
I recommend sending email to portfolio services instead of using the resale contact option on site. I did both. Portfolio services got back to me with deed back option in about 10 days which I started right away.

Resale contact responded after 3 weeks saying there is no deed back program and gave me suggestions on listing prices of a couple thousands for each deed through one of their partner realtors.

OK, so what was the deed back option you got from Portfolio Services?

I posted details in another thread. They sent an agreement for me to sign and e-mail back then a few days later I received a warranty deed for each one that required notarized signatures. I'm still waiting for process to go through completely. It's only been a week since they received the signed documents. Requested update on Friday morning but haven't heard back yet but it is holiday weekend.

So they finally got back to me and said it’s going to take 90-120 days to process the deed back. I followed up asking if I needed to pay 2024 fees for those deeds and they said I did not since the process has started.

Please report back once the deed back process is complete. You're the 3rd recently confirmed owner going through HGVC's surrender process.

Sounds like HGV is changing their tune on deedbacks! This is great news! Wonder if they are in need of some new inventory. Cheaper than ROFR.

I wonder if this does lend some credence to the sales people in HI and other places saying they are "out of" deeds? Maybe they need some more bad ones to try and sell. :-D

In reality I don't know if I would say that they need some more bad ones to sell. At They usually are trying to sell the newest and most expensive deeds perhaps in the location that you are staying at like Maui. When the price blows potential buyers away they need inventory at other less expensive properties(resales) to offer and say that you can book at 9 months out at the same property for half or less of the buy in cost!
 
OP here.

I reached out to pfoliosvc@hgvc.com and after 10 days they sent a physical mail telling tell they are willing to take the property back. They won't pay any price. My property is in Big Island, Hawaii. So, they are taking properties outside NYC also.

The good news is that it appears that owners don't have to pay HGVC a price to take the property back unlike some other timeshare programs.

Thank you for the info about not paying the 2024 MF when your transition process has started. I'm in a similar situation. I have started the transition process on and sucessfully submitted the request on Jan 3, 2024. My 2024 MF is due Jan 15, 2024. I talked with the DRI transition member for about 30 minutes when she reviewed my Conditions to Apply. I also asked about if I need to pay the 2024 MF. She told be I don't need to pay as I have started the transition process. My question is "Did you have the instruction not to pay 2024 in writing"? And to all the experienced forum members "Should I get the note not to pay the 2024 MF in writing"? I'm concerned that by not paying, it may have a adverse effect on my transition outcome. This info on this Forum has helped me tremendously on the Transition. Thank you.
