wrong address on my deed

I have purchased a westin TS 2 months ago, and I got the deed a week ago.
While I was reading the new deed carefully, I saw there was an error for my address. My name is right, but my address is wrong.
I contacted closing company and let them know the address is wrong, and they sent me an e-mail today, and said, it would be ok as long as the resort has my right address. And if I insist to redeed to correct the address, they will charge money to me for this extra work.
Does it sound fair? They put the wrong address on deed, and why should I pay the money to correct it?
It is the first time address error on deed and I am wondering if I have to redeed or not?
Thanks for your opinion.

I would call Starwood to double check and if it's OK with Starwood, I wouldn't bother changing the deed. Look at it this way - you could move next year and it would be wrong then, too, but you wouldn't have the deed changed. Go with whatever Starwood advises. If Starwood says to change the deed, the closing company should NOT charge you for it! I'd ask Starwood to send you an email confirming the address change, too.

When I Make A Mistake, I Try To Fix It. Why Can't They Go & Do Likewise ?

On the 1 hand, they made a mistake & they should be willing to correct it.

On the other hand, if you move to a new house sometime after the deed is already recorded, then the address on the deed will be wrong -- with no need to correct it since you're you no matter where you live.

Bottom line = Mox Nix.

Well, generally I agree but, what if the county bills property taxes from the deed? Additionally, I remember a case a while back where someone had left money in a bank many moons ago. It had to be forwarded to the State Treasurer's Office where it was held for several more years. In order to claim the deposit he had to produce documentation showing that he had lived there at one time. What a pack rat-he found an old tax bill! :eek:

In the state whose law I am familiar with, the mailing address of the grantee does not impact the legal validity of the deed to pass title, but there may be a state out there where the law is different. Unless it impacts passage of title, there is no need to record a revised deed, but to be safe, you might want to consult an attorney in the state where the timeshare is located.

The other issues are those who need a correct address to send you bills. That is always true with the t/s management, and if the tijmeshare is in one of the minority of states which bills taxes seperately to each owner, that will include the county tax office as well. As long as you make certain that all of these have your correct address, it really doesn't matter what address is on the deed.

In all timeshare instances I'm personally aware of (..and that certainly ain't everywhere...) the county sends the resort one collective property tax bill. The resort / management company then handles all individual owner billing. I can't imagine a county voluntarily choosing to get involved in individually billing " X" number of individual owners times "Y" number of individual units times 52 separate, individual weeks for each resort in their county. :eek:
Now I'm curious --- where are they foolish enough to do such a thing?

Believe it or not, some states bill TS property tax separate...

I've corrected erroneous addresses on a deed by contacting the property appraiser's and tax collector's offices. It may not make a difference in where they send notices and bills, but as it is a public record, it could show up in your credit records.

But something unusual happened when my wife and I bought a second home. It was listed and contracted for one street number (7209), but when I tried to activate utilities, I found that they had a different number for it (7151). It wasn't that it occupied two lots, just that the post office and local utility had simply used different numbers.

I casually mentioned the problem at closing and everthing came to a stop for two hours while they tried to figure out which number should go on the paperwork. They said that it wasn't that it mattered to us much, since we knew where the house was, but that it mattered to the mortgage people.

I've heard of cases where the utilities and the post office have different address. Not too long ago some of our neighbors woke up one morning to find that they had been moved into a new zip code. Normally you wouldn't think that was a big thing until they got their car insurance bill. Guess what, their rates went up strictly based on the zip code change!:eek: I am surprised that title was held up since the legal description normally is the official description of the property but, I could see how it was something that could be a concern.:doh:
