what to do next? escalated contract withdraw

will I be black balled and everytime I try to make reservations will theytell me there no rooms and make my stay a complete and miserable time from here on.
I doubt it because you'd be dealing with a different set of people. Right now you're dealing with the sales dept. but they don't have anything to do with making reservations or with the day-to-day management of the resorts.

No. I am a Wyndham owner and you will reserve what you want through the computer system. If they try to do anything to you, like block you (they absolutely won't do that), we will all help you complain. I will be the first one on the phone to Owner Relations.

I think you will be just fine with reservations, should you be stuck with that horrible deal you were trapped into purchasing. Elaine is right, you need to send a letter to the Texas AG. Very important!!!

Some other owners (generally resale) have heard this same thing...You can book the new resorts blah blah blah. It's a line of complete BS. No matter what kind of hell you raise if you still have your product, you will still be able to use it. And if they flag your account and refuse to give you owners updates when you stay at the resorts...BONUS FOR YOU!!!! Also from what I see you can book pretty much anything at 10 months out especially at Grand Desert.

You're not the only guy who bought retail and came to see the error in their ways. Me too.... :doh: Though my error was almost 15 years ago, all I can really say is "NEVER AGAIN" :deadhorse:

I know it hurts but I do think that this wave has crashed ashore in your case. That money is gone and it ain't coming back. "But" others here seem to think that you may have a chance with the Texas AG...definitely swing that bat...especially since you want to go to the Baseball Academy...I know, mixing metaphors and awfully cliché... but it fits.

From a "Been There/Done That" perspective, I really don't have much to add to those that have told you the Wyndham system really isn't that hateful to use once you get over that whole "Those Bassturds" attitude. Personally, I like the Wyndham system and I have not been disappointed by any Wyndham stay...aside from the Weasel Dance, which I avoid now. Honestly, the Hamster Dance has better music.

You said you now own 105K points...is that an EOY or an annual usage? Do you realize that there is a monthly Maintenance Fee that must be paid? More than a few owners have had their feeling hurt over that issue. BTW, just how much are your MF's? I have 105K points @Kingsgate running $52.96/month for comparison purposes. Given that you wanted San Antonio, the Advance Registration Period is probably worth it to you. Still, you going to San Antonio every year? Seems repetitive in my book...this coming from someone who has never been there BTW, so take that advice with a grain of salt.

If you really has issue with the deal, you should contact a Taxas lawyer and send to AG cc Wyndham asap. I don't see any reason Wyndham will just give up to claim you have a legal signed contract without fight. ARDA will not help you, they will more help in-line with Wyndham. FTC will remotely help you. If you like, you can cc them.

Since you have been owner for over 1/2 year now, you should be able to get in on-line. Check the availability. You know your baseball schdule, check for that. You can always determine your cost/effort and chance to against them compare to your effort to keep that contract and learning just set up your date in advance, and make reservation on 10, 9, 8, 7, 6 month early and your chance of getting it. Than you can make decision yourself before you spend big money and effort. Most of the time, people find with a little bit planning, they do get what they want in reservation, and it is less costly than just go to court and fight a he say we say situation with their signature all over a well prepared legal document.

If you can not afford the contract, that will be another story, in certain situation, you maybe able to get out of it with same damage on your credit score and loss of money. Since you mention your mortgage is on-the-line. But you will than need to talk to your local bankrupcy lawyer.

As to marriage, this maybe a bad situation, but it should not be more important than your marriage, so don't let it destroy it or give you an execuse to balme your wife.

I hope and prey that tomorrow which will be the 5th day after this went to consumer affaires legal. I will have something good to say.

To answer your questions my MF is 44.97 and I can use them anytime anywhere. OR that is what they told me I cannot be for sure right now what I have. I am still finding out what I can't do. I really don't know what I can do. no one has been able to tell me the last posative contact I had the lady could not find my contract. and the salesman did not rember me and that was only 45 days after he conned me. so yea I would really like to swing for the fence with whatever hits the bat to fly over the wall.

on onother note how much can i expect the mf to up and how much will the assesments be? I have herd stories of thousands and there is no way for me to afford it. I did purchase in San Antonio but dont't plan to go back. ever. I'm not bitter just pissed.

Grab the bull by the horns. See if you find a Wyndham facility(hotel, TS etc)near you. Sue them Pro Se there and ask for JURY(constitutional right) trial. you do not have to be a lawyer to sue. The worst case is that your suit is dismissed for wrong venue. But they will have to hire a lawyer(expensive) to represent them in court which may induce them to settle. do not lie down and play dead.

Pro Se is Latin for for yourself. Ie you are not a lawyer representing someone else.
Go to the courthouse and tell them you got screwed in Texas, maybe someone will help you with the procedure for filing the lawsuit.
 
my copy of the contract was missing the left 2 inches and the length of time was conviently not there. as well as 2 inches of every page. I did not receive a complete copy of the contract. so not only do i have to rely on what was sold to me but I have not found anyone at Wyndham since 6-29 that is willing to help me what so ever.

If I am reading this correctly, you are saying that the Length of time (5 day right to cancel period) was missing from your copy of the contract? If so, I would take your contract with the 2" missing to a Real Estate Attorney. One thing they HAVE to do is advise you of your right to cancel. Many Real Estate Attorneys are making a living getting people out of their Mortgages for improper notification of their right to cancel.
