Want to Sell, Need Some Help Starting

Hi All,

I need help! My parents signed their timeshare at Sands of Kahana (Maui) over to my 2 brothers and I about 5 years ago. We have kept it in the hopes that we would use it, but unfortunately none of us ever has. The cost for us to get our families to HI outweighs the savings on the lodging. We would like to "sell" it and so have begun doing some research here on TUG.

Here's what I have done so far:
1. I became a member and can see that was the right start.
2. I contacted the property to see if they have any sort of surrender/buyback program or allowance.

But I still need some help with what to do next. For instance, since we have never used the timeshare (or any timeshare for that matter). I am not even really sure how it works. I don't see a deed in any of the paperwork from my parents, only an "Ownership Conveyance Document." I have never sold a house before and don't know if I need a lawyer or a real estate agent or someone to draw up the sale paperwork. I can log into the Soleil Management website and see the property, but that about all I know.

Any help and advice would be greatly appreciated.

First, welcome to TUG. Second, what did the resort tell you when you asked about a surrender program? When you mentioned that your parents signed their timeshare
over to you and your brothers, how did they accomplish that? Are you receiving annual maintenance fee bills for the timeshare and have you been paying them?

Thank you! I called last weekend, which was the holiday, got forwarded & put on hold a couple of times and finally just left a voicemail and haven't heard back yet. I also sent an email to see if I could get a response that way. I will try them again this week during regular business hours. The document that we signed is a legal document that says "ownership conveyance" but I don't see anything that looks like an actual deed or title. I am trying to get my dad (who is quite elderly at this point) to look for any original paperwork at his home, my mother passed away a few years back. We do pay the annual maintenance fees and what I think are property taxes, so those are all up to date.

Thank you. I am having my dad look for anything that resembles a deed and hoping I am able to get a hold of someone at the management company during the week.

If I recall correctly, Hawaii deeds require more steps to transfer ownership than mainland based ones. Here on TUG, we recommend use of LT Transfers. www.lttransfers.com/ they are TUGgers and provide reasonable, professional transfer services. Of course the resort, or transfer company may also list possible buyers since your resort is not in current sales. Good Luck!

Easiest thing to do is just do a search online with the Hawaii land records system. If it is a deeded timeshare, you can enter your dads last name (first and last if last name is common) in the grantee/grantor box.

It will pull up all deeds recorded where your dad is the grantee or grantor of the property. Probably faster than your dad searching for the deed copy unless he is super organized.

If the DEED was never transferred out of your Dad and Mom's name and the siblings do not want it just stop paying the Maintenance Fees. Tell your Dad to ignore all letters and telephone calls from the Timeshare company.
