Urgent - Westgate Fiasco!

Ughhhh! We freaking fell for it. Just bought at Westgate Las Vegas casino property today. $10,900 for deeded 1 bedroom on even years with $2000 credit towards unlimited getaway weeks blah blah blah...supposedly a unit that became available because someone upgraded to a 4 bedroom.

About 10 other couples also purchased during the 90 min pitch we listened to. The model was beautiful and convincing, I will admit that.

Anyways now we're reading all these scary reviews online and feeling remorseful. Also the whole exchange process with Interval does not sound as straightforward as we initially believed after reading nightmare stories on Tripadvisor.

We are here in a hotel room at Westgate Las Vegas tonight.
We were meant to go home to Tucson today but decided out of curiosity to listen to the pitch before we left and ended up spending hours going through the process. We were given discounted show tickets (we paid $40), free dinner buffet, and tonight's stay in a $240 room for $47 since we couldn't drive back tonight after the pitch & purchase. Anyway, honestly mathematically it seems like the timeshare makes sense for vacation savings. But we're just so skeptical by all the negative reviews we want to cancel.

We are going to go to the office in the morning and try to cancel with the lady we closed with.

OR IS THAT A BAD IDEA???

Should we strictly do it by mail??

We paid $300 down payment. Is that just gone? Or can we expect to get that back when we cancel?

Do we owe them for the show tickets/hotel room/buffet?

It's 4am now...so stressed. Any advice appreciated!

They may want compensation for the room and anything else they gave you because you bought. Anything they gave you as an incentive to attend the presentation is yours to keep. If you want to go to the office to tell them you are rescinding fine, but you also need to follow the instructions on the cancellation notice. We didn't want to have to ship anything back to DRI after buying and changing our minds (they gave us a faux iPad with the documentation on it), so we did that in person and then followed up with the recision paperwork as per the instructions in the documents we signed the day before.

I have no direct experience with westgate, but the rescission language ought to be in a paragraph in the purchase and sale agreement (contract) you signed. Follow those instructions. If they say call Santa Clause, do that, If they say return to the sales room, do it. You owe them exactly what the contract language says you owe them...follow the letter of the law (your contract)

and yes, going back to the sales room is a bad idea, It might work, but its not what your contract says....

The contract will give you a mailing address. and a timeframe. the law is different in each state and Nevada gives you 5 calendar days (I think this is current) so be at a postoffice today (if there is one open, on Sunday,, or tomorrow morning. You are on a tight schedule

In Nevada, a purchaser has the right to cancel a timeshare contract until midnight of the fifth calendar day following the date the contract was executed (Nev. Rev. Stat. § 119A.410).

Most of the time, the cancellation must be in writing. The cancellation letter should include the following information:

the purchaser’s name as it is written on the contract
the purchaser’s address, phone number, and email address
the name of the timeshare company
the timeshare description, and
the date the timeshare was purchased.
It is usually not necessary to provide a reason for canceling the timeshare contract, but you do need to state that the purpose of the letter is to rescind the contract. For example, a statement such as “I am contacting you within the rescission period in order to cancel this timeshare contract” will generally suffice.

The method by which you should deliver the cancellation is usually contained in the contract itself. Some timeshare companies allow hand-delivery of a cancellation notice, while others will only accept delivery via registered or certified mail. Be sure to follow the instructions exactly and make sure the letter is delivered within the applicable rescission time period, otherwise your cancellation may not be valid.

and by the way relax a little. This happens all the time, many of us have fallen for the sales pitch at a timeshare resort at least once and havent had the good sense to rescind. Wesgate is Know to be one of the worst, but I think they do follow the rescission laws if you follow the procedure.

Once the dust settles, and tou have your deposit back read a little about timeshars, spend a little time here on TUG, You may decide to take another look, but not in the sales room. Just like there are used car lots and new car showrooms there is a secondary market for timeshares. Its not just the developers sales rooms. You will be surprised at just how cheap this stuff can be to buy (maintenance fees are another story)

You should rescind by mail. USPS Certified. Send it to the Ocoee, FL address. Do not go near the sales room in Las Vegas. They are trained to counter any argument you have, and that isn't the business office anyway.

If it were me, I'd pack up and head home. No good will come of hanging out in Vegas any longer.

It's possible that you may have to pay full freight for the hotel/show/buffet because those were perks of buying, not just prizes for attending the presentation.

Wastegate are nice resorts but their predatory practices both pre-and after the sale are atrocious. They are only out for Westgate. Period.

Get some rest and head home.

Thanks for all the replies, advice and encouragement.

We went back to the office this morning. I found a cancellation letter in the big black binder. We took the binder, tablet, and signed cancellation letter with us to the office.

At first there was supposedly no one available to meet with us, so they said. They were very busy with new victims.

We demanded five minutes to meet with someone to cancel.

A manager begrudgingly met with us. He was condescending in tone and made a comment alluding to us changing our minds because we couldn't afford it, which was not the case. We said we simply do not feel informed enough to make a large lifetime purchase, especially after taking the time to research and reading bad reviews about the company. He brushed it off as "whatever, your loss then."

We gave him the cancellation letter, and he made a copy for us. He said he would take care of it and fax it to the corporate address Mon morning.

We left the office and then realized we had no receipt of our contract or our deposit because we gave him the entire black binder. We went back and got a receipt for the $300 we paid. When asked if we could expect to receive that back he said in an annoyed tone "yes, they are a big company and don't play games like that" (hahaha riiiiiiiight!!!)

We are still going to mail a copy of the cancellation letter to the corporate office first thing tomorrow.

Thanks again everyone, hopefully this ends well!
