Upgraded week to Trust

Hi everyone. We recently upgraded our deeded week at Point at Poipu, mainly because we like using the points mostely, and were told that in order for the points to go to our kids when we pass, that it would have to be in the trust. Also if we wanted to sell, that the points wouldn't go either, it would just be the week. It all happened so fast, I wasn't feeling good at all when I went, and almost wonder if we made a mistake, but not much I can do about it now.

Now on to the problem....I have been getting calls from the Diamond Resorts finance department saying that I have to pay my Maint fees for the old contract first before the upgrade process can continue. He then went on to say then on the new contract I will also have to pay the maint fees. I am so confused I don't know where to start.
We had 5000 points on the old contract, we bought 4000 points more and upgraded the 5000 points, so a total 9000 points in the new contract. The guy was basically saying I needed to pay the 2009 maint fees on the old 5000 points, and then 2009 maint fees on the new 9000 points. None of this makes sense. Has anyone had this issue, or know anything about this.

Timeshare Trust = Oxymoron ?

I am so confused I don't know where to start.
Maybe the problem is punctuation.

Instead of just Trust, possibly it should actually be "Trust."

I for 1 don't trust the timeshare sellers as far as I can throw them.

Some of what DRI told you is true but IMHO, switching to the "trust" isn't an upgrade but a bad choice. You owned a week at a great resort in Hawaii. Now you own points which may or may not get you a week in Hawaii. Also, The week is more valuable than the points in the trust so if you do sell you'll likely get much less now than before the "upgrade". And everything they said about your kids is a lie!! If you give the kids the week, they will be seen in the eyes of DRI in exactly the same way you were seen.

Of course you do not have to pay the MFs on the old contract and the new one. BUT if this problem can get you out of this "upgrade" do it. GET OUT!!.

The only thing you should ever buy from the developer is a cup of coffee at the cafe in their lobby.

No Exceptions.

What did this "upgrade" cost you?
