What makes this seem "Legit" to you?

It's most likely a Viking Ship company.

The new timeshares abandonment model is a the "Viking Ship" scheme.

The scoundrels do not take ownership of your timeshare, so the only cost to them is re-deeding it (just a matter of doing the paperwork) so they can do it dirt cheap.

Many resort management companies refuse to accept deeds from these companies, because it's a fraudulent transfer, that harms the HOA.

I can't see how any entity can honorably, or legally release you from a properly executed contract. Those Viking Ship contracts wherein an owner quit-claims their deed or signs over a power of attorney to an entity may be marginally legal, but they sure as the sun rising in the East, aren't honorable.

This is MTS. Do a search for Mexican Timeshare Solutions and you will see some tug threads on them. http://www.tugbbs.com/forums/showthread.php?t=170500&page=2

They specialize in RTU contracts. I don't think they deal in deeded property but not certain. In short, they will provide paperwork to you showing that your timeshare contract has been cancelled. You contact your resort and if they verify that it has been cancelled then you owe a huge fee to MTS unless it was already paid to some type of escrow. They have had happy customers. They pay the BBB for their rating so don't put any weight in it.

Could you do what they do for less? Probably, but most people don't want to learn how.

MTS contract

Here is a contract I got from MTS, any thoughts on it? They are not asking for money upfront. I've got Sandos Caracol Royal Elite Club membership, which is not a timeshare (doesn't specify weeks that could be used). I was trying to cancel it with the resort but wasn't able to get anyone on the phone. I was advised by PROFECO to send a cancellation letter, but I was already a few days past 5 days cancellation period by the time I found out what to do. I was trying to negotiate with Royal Elite Club but you can't negotiate with mafia, they want your money and they will use mafia tactics, already threatening me with collection agency.

INITIALS CLAUSES
1. DEFINITIONS:
The specific terms that shall be used in this contract are defined according to the following:
a. CLIENT. - An individual or individuals who have the legal faculties to hire and have the desire to hire the services of MTS for counseling and legal defense related to the tourism services providers contract at issue.
b. MTS. - A professional firm in Mexico whose desire is to provide clients with representation, assistance and advise in the manner of services specified in this contract, for remuneration.
2. OBJECT OF THE ACTION
a. MTS agrees to give advice by all means favorable to the CLIENT and to defend the rights of the CLIENT against the
Timeshare Developer.
b. MTS agrees to give monthly written notification to the CLIENT of the actions made on behalf of the CLIENT.
c. MTS agrees to provide legal defense, for any type of trial before any court of law in any State of Mexican territory.
3. TERM OF THE CONTRACT
The term of the contract is one year, starting with the date of signature and can be extended if Trial is pending or if client requests an extension of time
4. PAYMENT OF FEES AND COSTS
In consideration for the services described, MTS will receive the fee described below. This shall be paid as follows:
a. If the contract is cancelled with Royal Elite(sandos caracol) , the CLIENT agrees to pay MTS $1,700.00 USD, and
b. If MTS recovers any monies from Royal Elite(sandos caracol), the CLIENT will pay 20% of the monies recovered to MTS
upon receiving the refund from the Timeshare Developer.
MTS will not collect any more monies but the described above. If MTS incurs any extra expenses, MTS shall absorb the cost. This money should be paid by the method agreed with MTS. It should be full payment and in American dollars. Should CLIENT become more than 7 days delinquent in the payments described herein MTS reserves the right to add a 5% monthly interest charge to late payments.

INITIALS CLAUSES
5. ADVANCE TERMINATION
MTS and the CLIENT recognize that MTS has spent from their own funds diverse expenses such as paperwork, translations, certification of documents, wages and other expenses. Therefore, if this Contract is cancelled by the CLIENT through voluntary retraction and if the CLIENT recovers monies paid to Timeshare Company as a direct or indirect result of the efforts of MTS, the CLIENT agrees to pay MTS the fee as described in this contract.
6. RESPONSIBILITIES OF CLIENT CLIENT agrees:
1. To establish constant communication with MTS.
2. To tell the truth.
3. In case the CLIENT cannot appear at Trial, the CLIENT would grant power of attorney or related authority to MTS to
perform the actions necessary for the CLIENTâ€TMS defense.
If the CLIENT does not perform the responsibilities listed in this clause, MTS will be relieved of its responsibilities set forth in this agreement.
7. RESPONSIBILITIES OF MTS MTS agrees to:
1. Answer all CLIENT concerns about the process, trial, or actions being made on behalf of CLIENT.
2. Act immediately in the defense of CLIENT.
3. Tell the truth
4. MTS will make every effort to obtain a cancellation letter from the Timeshare Developer via email or certified mail. The
CLIENT will receive a Contract Cancellation Confirmation from MTS guaranteeing that the contract has been cancelled successfully.
8. LAW AND JURISDICTION
This contract shall be governed by the laws of the state of Jalisco, Mexico and the parties submit to the exclusive jurisdiction of the courts of Mexico in respect of any dispute or difference between them arising out of this contract.
Client understands that This Agreement may be executed in counterparts each of which shall be deemed the original, all of which together shall constitute one and the same Agreement. A faxed copy or other electronic copy shall be deemed as an original.
By initialing each clause above and signing and dating below, the parties hereby acknowledge they have read and understood the content of the contract, which was presented on 06 - January - 2015.
 
Based on the venue clause, I would just stop paying

As to the collection agency, there is nothing they can do but threaten and lie to you on the phone. Change your phone number or don't answer any numbers you do not recognize.

Seeing that you are in Canada, and MTS is in Mexico, I can't say we are speaking from a position of informed authority. But frankly, since there is no deed, you don't actually OWN anything. You DID sign a contract for which you get the use of SOMETHING. If you default (stop paying), about all they can do is threaten credit damage. The question is if they can do anything about it. I know very little of how Canadian credit is rated. Is there a mechanism allowing a party whose credit has negative reports, or goes into collection, to write a rebuttal or explanation? I find it hard to fathom that a timeshare outfit will put much effort into collecting from you after you've made a good faith effort to rescind a contract- even late- and have opened a file file through PROFECO.

We wish you well. Keep us posted. One tactic we've seen work with other entities is to post negative reports all over. Here on TUG, TripAdvisor, various travel and vacation sites. The worst thing for them is bad publicity keeping other 'Marks' like you were from attending their sales presentations. Often it comes down to you posting retractions of negative reviews in exchange for you being released from your contract.

This is an article that is what happened to me. I received this letter.

Ms.Griffin,

Thank you for your email. I understand the procedure of the presentation and how it is offered. I also understand the paperwork that constitutes your contract. During the sales presentation, when you chose to purchase there is also a procedure that every new member must go through to obtain their final signed copies of their contract. This entails not only providing your information and authorization for the elaboration of the contract and the signing of the documents, but also the signing of additional documents with the Developers Representative who at that point explains to you not only who to contact for your different use needs, but also our liability and your responsibility should you choose to rent your week(s). Some resorts in the industry do not allow provisions for rental, however, as we do, and as we understand that there is a myriad of companies who offer this service, we are very clear in explaining that we do offer our own rental pool for owners that does not have a fee for use, however, at the same time is not guaranteed, and in the event you choose to use an agency of your choice, you can do so, with the understanding that the Developer does not endorse any outside companies and will not intervene. Having said that, I think it is clear that we cannot assist you with the company you chose for this service.

The terms for cancellation are also very clearly depicted in your contract, and we were never provided a cancellation request by you, in person or in writing. Just as you have sent the inquiry below, you could have used the same method to send your cancellation request. You were contacted by our member services department as well as our billing department on several occasions and your request for cancellation was never brought up.

I do not know what kind of recovery this second company is hoping to make with your membership as I have also checked into the status of your account and it has been cancelled for months now due to the fact that it was never paid for. Your promissory note is in default and instead of the resort sending you to an outside collection agency which could have affected your credit, the resort chose to retain monies paid as liquidated damages.

At this point any complaints you have regarding the use of your membership, either personally or through rental are a moot point as your membership was never paid and you became in default with the legal binding contract that you signed at the resort.

If you decide that you need to report your situation to the parties mentioned below, please be sure to mention that you do not own a membership due to non payment and please provide what you can that is documented, as hearsay cannot be proven and we will provide all of our documentation that is mostly contrary to your account of events passed.

That's how I read it. You defaulted. They never instituted your membership. They kept your down payment. They say they never received a rescission letter. I suppose that if you have copies of the rescission letter and a receipt from the post office showing the postmark when it was sent, you might have a chance of getting back whatever they kept of what you paid, but it would be a fight.

MTS or Mexican Timeshare Solution is a company that offered to help me to get rid of Royal Elite Club membership for $1700 USD payable after they help to cancel my contract. Royal Elite uses Monterey Financial collection agency that is located in CA, US. I asked Royal Elite Quality Control rep to cancel or I will be posting negative reviews all over the internet.
Adrian Venter (customerservice13@royalelite.com) keeps giving me the same answer:
"If the request is outside the 5 days the membership can not be cancel if the contract is not pay in full.
Thats is why Royal Elite is offering you an special discount to help you with the finance problem (that was a 10% discount off the original full price)
Since you asked for the cancellation request we have 30 days to have some kind of arrangement with the members this is why we gave you an special discount as a part of the benefits for you to dont loose the money that you envesteed with us but the most important thing is to dont send the contract to the legal department and to collection or the credit buro."
I have posted my reviews and comments on Tripadvisor, Reviews Talk consumer reviews, Ripoff Report, ComplaintsBoard.com, Ontario Government website (Collection agency: your rights) ...any other ideas? Should I send all those links to Royal Elite?

how much is your deposit? surely it wasnt 1700 dollars?

paying that much money in an attempt to recover a deposit seems....odd?
 
Deposit was almost $6000 USD and Royal Elite is demanding to pay the rest of it - $12000 USD or they would send it to a collection agency.
I just sent an email to Royal Elite rep:
"Please be advised that I am beginning to post negative reviews and complaints about Royal Elite Club all over the Internet. So far I have posted 10 reviews on different Vacation Forums, Complaint Boards, Vacation Sites. I promise to post at least 10 negative reviews daily in many languages to inform people of your money extortion techniques. You will lose more money by trying to get money from me. Bad publicity will hurt your sales. The only way I will stop is by getting my membership cancelled. I've sent you my cancellation request, I did not demand my down payment back, I even proposed to re-negotiate and downgrade my package, but Royal Elite clearly doesn't care about members and only cares about squeezing as much money as they can out of members.
I promise to keep track of all of my internet postings and remove them as soon as I get confirmation about cancellation. Please discuss it with your supervisor. Thank you for your understanding. "
 
Follow up with them to see if a Canadian Credit reporting bureau would accept data about a delinquency in Mexico.

Under US the out of pocket costs of attempting to "domesticate" a foreign judgment are reserved for cases far larger than any timeshare debt.

I challenge for anyone to post an actual experience (not threat) that their credit has been adversely affected, or any judicial action, by non-payment or default on a agreement under Mexican or any other international transaction that was not part of a company operating a sales office "off-shore" for their US based headquarters.

So you're thinking of paying about $2000 Canadian to essentially (if MTS is successful) to protect your credit rating? Is that a good trade-off for you?

Besides, these so-called cancellation services usually just simply negotiate with the TS company (or whatever creditor you have) to either take the deed back if it is a deeded TS or, if it is an RTU like in Mexico, to just accept whatever down payment you made and call it a day. These are things that you can do yourself.
 
Thank you everyone...I will keep you posted. So far I did not get any reply from Royal Elite Club. They are not interested in negotiating. :mad: That is why I was trying to find out info on Mexican Timeshare Solutions. But it would be very helpful to hear from someone in Canada being harassed by Monterey Financial Services or other collection agencies regarding refusal to pay for their fraudulent vacation memberships.
