Timeshare law firms to avoid?

I would like to look into my options as I believe we were within our rescind time-frame based on closing date. Just wondering if anyone knows good law firms to contact in Florida or any to avoid? We are getting push back from MVC.

thank you

To add, the instructions and address are in the contract you signed. They may even have a template that just needs signatures.

Sadly, if you purchased it more than 10 days ago it is highly likely you are now an official owner.

With that said, be extremely careful where and how much you spend in order to fight your legal ownership; it could be a very expensive proposition and may or may not be the best move in the long run. Keep in mind you are fighting a Company with very deep pockets.

Best of luck!

Rescission rights are based upon the date you signed the original contract, not the day the purchase closes. Purchase transactions never close prior to the rescission time period expiring. If you are basing your claim on the closing date, you are too late to rescind.

As others have said, your rescission clock starts at contract signing and not at closing.

A legitimate lawyer may be able to review your case and advise you from there. However, they will most likely just review your contract for any loopholes. Unfortunately, if no loopholes and if you did not rescind within the rescission period there isn’t much more they can do.

A word of warning. There are many exit companies that promise to cancel your timeshare for a huge upfront fee. Some will imply they are lawyers, or have a legal team. These are going to just scam you out of your thousands of dollars.

If you believe you were misled in any way, write to the AG. Thoroughly read TUG to identify any misinformation you might have received. In a CNBC short documentary, a couple's contract was canceled successfully after they contacted the state AG. While details were not provided, and it involved a different state and company, it could be worth a try.

As others have said, it's normally based on when you sign but there are other conditions that must be met including delivery of certain documents and written documentation of said right to cancel. For FL at least, many of these requirements also apply to resale purchase as well even if done privately but not all conditions apply to resale. While realistically only applicable to a subset of private resale purchases, the timeframe to cancel can be extended to a full year in some cases though accomplishing the cancelation may be quite the task and may indeed require the lawyer to get it done.
