Not sure where to post this, please move if this is wrong spot. DH and I own 2 weeks at a timeshare in Reno, Nevada. Owned them since mid 80's. DH is not in good health and wants to have my name removed from the deeds leaving them in his name only. He is concerned that if something happens to him I will be stuck with TS that I would not want and could not afford to pay Maint. Fees on. The resorts policy is they will NOT take the weeks back under any circumstance. The owner(s) can sell the week or give it away and pay the fees to have title transferred or let it go into collections and foreclosure. Sounds harsh to me but I know that this happened to one lady when her husband died.

Since DH is trying to protect me I was wondering if any TUGGER with legal expertise knows if what he wants to do is possible?

TIA,

Suzanne

It's possible, it's easy, and any title company or any of the services touted here on TUG for document transfers can do it.

And it will even work -- unless the resorts analogize your husband to a viking ship (which is, of course, what you are doing).

Whether it is possible or not will depend on the particulars of your resort. It may be possible, but it is not as simple as making a transfer to somebody else would be. Aside from the resort bylaws, you also need to be sure you avoid complications from the laws in both Florida and Nevada.

It will not be easy to convince anyone it was his separate property should the resort come after you through courts for fees after his death given the joint ownership for thirty years.
