Timeshare Credit NIghtmare

Several years ago my wife and I purchased a timeshare at Tahiti Village in Las Vegas. A few years into owning this thing which we rarely used we were asked to attend an owner's weekend package and got to stay for free as they explained how things were changing. They explained that our every other year week would be useless to trade unless we converted our investment into points with RCI and we would then be way better off if we upgraded to every year equivalent for RCI points. It cost us a new mortgage of 8K. Soon after that I got sick with Cancer and discovered this whole timeshare thing was a scam. Much if not everything they said was a lie.
I decided to stop paying the mortgage and eventually tried to hire a Timeshare lawyer to remove us from the contract. Long story short they got them to stop the harassing phone calls and nasty letters. I eventually recovered from Cancer but I'm now currently disabled. The lawyer got us to quit claim deed back to them. They never contested it until 6 months later and said they were nullifying the deed being returned. Our lawyer fought and it seems on paper we no longer own it.
The problem is they continue reporting 120-day late on my credit reports for well over the past 18 months. The credit agencies won't let me dispute it because we tried more than once. Does anyone know of any options we have to get them to stop reporting these late's on our credit. Can they just keep reporting this forever? Every month is a new late entry on our credit. I'm not sure why they just won't foreclose and get it off the books.
 
Tell Tahiti Village your credit has now tanked. Them continuing to report you can’t hurt you any more, and your score won’t improve even if you start paying back dues. So they may as well take the timeshare back because they are never getting another dime from you.

It cost me 3k... I don't get bothered with any harassing phone calls or letters. I guess they will just continue to attack my credit rating. I'm a bit surprised they haven't decided to foreclose after all this time.

They don't want the timeshare back... they just want to continue the scam and collect from as many people as possible. They fought the quitclaim deed!

I hate to be the bearer of bad news but if you are still having repercussions from this then you spent a lot of money for a job which was not 100% complete.

If your credit report is still being dinged then your Lawyer hasn't finished his/her job and needs to take additional action on your behalf.

Always surprises me. Why not include a $2500 bonus if someone takes the deed when listing. Should work: many people will simply want it for the cash. And there is a chance of ROFR.

Far less headaches than using an attorney and no sale: no pain (well: the MFs & assessment risk will persist). But the odds of offloading are probably far higher.

Any individual can stop unwanted collection calls; I believe that right actually originates from the (Federal) Fair Credit Reporting Act. Attorney involvement was never necessary for you to achieve that one minor result entirely on your own --- at no cost whatsoever.

In regard to the previously referenced "quit claim deed" (post #1 above), I respectfully submit that you received some bad legal advice. A deed cannot just be unilaterally assigned without willing "grantee" acceptance. That "acceptance" is a fundamental requirement for any deed to be valid. If the "grantee" was not a willing participant (as was very clearly the case here), the recipient probably just threw that unwelcome and unwanted document straight into the trash. If it was possible to just unilaterally "quit claim" a deed to an unknowing and unwilling "grantee", then anyone could just randomly pick a "grantee" from the phone book. Obviously, no can do.
You stated that they "fought" the (unsolicited) quit claim deed. The fact is that they could (and plainly did) simply decline to accept it.

Foreclosure will occur at some point, but in the meantime I would respectfully suggest not wasting paying any more money for inadequate and / or incompetent legal advice ultimately accomplishing nothing for you. No attorney possesses any magic potions or mystical powers to extract you from a valid and legally binding contract into which you once voluntarily entered of your own free will.

The negative credit reporting might very well last for 7 years. However, if it's the only negative, lenders may take into account that the lone negative involves "timeshare" --- a word which in and of itself often elicits consideration of someone having been hoodwinked.

If I understand the OP's situation correctly, there is a still a unpaid mortgage balance of +/- $8K here. If that is still the case, then transfer of ownership is not possible until / unless the unpaid mortgage is resolved first --- regardless of offering "a $2,500 bonus".

How do you suggest OP get his lawyer to take more action? Pay him more money and still end up right where he is now? Not me...

Force him to complete the job he was paid for.

Unfortunately, the "job" for which that dolt accepted payment is a "job" which could not (and cannot) actually be accomplished at all.

Was this "Timeshare Lawyer" a real licensed attorney or just a company promising to rid you of your timeshare (an exit company)? If an attorney you got some real bad advice as any real attorney should know that you simply can't unitarily quit claim a deed (as @theo so eloquently put it). I would ask that attorney for my money back. If an exit company I am not surprised. They are in it for the large upfront fee and will do the bare bones minimum on your behalf. If it doesn't work they will just keep stringing you along for months, even years because they don't want to give up that big fee.
 
Obviously the TS needs to be paid off before it can be sold resale.

Asking a resort to take back an unpaid for TS is even more difficult to accomplish than a paid off TS in most cases.

But for paid off TS' offering a big cash bonus to sell makes more sense than paying "exit companies".

And that's a point that many here on TUG try to drive home for people who come on here asking, "Should I use such-and-such Timeshare Exit Services or such-and-such Timeshare law firm?" Even if the company is legitimate and accomplishes what you pay it to do, it will still be a lot cheaper to do it yourself and offer an incentive than to pay a lawyer, charity, or exit/relief/cancel service.
 
How many successful sales have been made on TUG over the years as I see in the ads that many are offering their TS for 1 dollar?

And many are offering theirs for free in the Bargain Deals section. Some are even throwing in an incentive such as paying the closing/transfer cost as well as sometimes the next MF.
 
Have you called the lender/developer/management company and asked if they will take a deed in lieu of foreclosure?

You realize that Google ads are tailored to you, meaning the ads you see are personalized based on your online activity and interests :ponder:. So you are slighting yourself, not necessarily this website. I also understand that ads are not shown to those that are logged into the forums, so not sure how you would see ads on these pages anyway.

Wow. I have never seen an ad for a porn site in my life. I think you just informed the world what AI models think what will be of greatest interest to you based upon your online history. You can rest assured that whomever you're sending to this site will almost 100% not see what you're allegedly seeing. :)
