Ask the resort for the legal basis of a so-called "transfer fee." If it isn't in the declaraton or bylaws, depending on the state, then is a junk fee. One resort where I used to own backed off when I politely asked for the legal basis.

I'll have to give that a try. My only thing is I've already put the fee in escrow. I guess they could reimburse me for that fee if I can get it done.

I used to use them but it took so long to get anything closed I stopped having them close anything for me.

I think the reason you are getting such a good turnaround is because of the lack of sales in the churn. There are substantially fewer closings due to the lack of interest in plunking down a sum of money to buy a timeshare.

I'm glad some of you had a wonderful experience with them. I, for one, will never use them again.

The bylaws deal with the internal workings of the HOA and would not be sufficient authority for something that impacts your property rights. That would have to be in the declaration.

Our management company charged $75 and kept the entire amount of that fee--not a dime went to the IOA, and I thought it was ridiculous; however, PA- is the president of our association and saw nothing wrong with it. What's your opinion, Steve, as a person with your knowledge and experience? Do you think a management company should charge for this?
 
The transfer is by the recording of the deed, the so-called "transfer fee" is basically extortion (unless part of the declarations pursuant to state law).

Translation: pay us money or we will not respect your property rights, we might even just let the former owner continue to use it, so pay us or else.

Lots of condo litigation where there is more to argue about where managers try to charge for things not covered by the declaration.

I don't know what other management companies do, but it seems many are given free rein to do as they please, and the BOD mostly don't know the difference. :rolleyes: It's extortion, pure and simple, and the people who are most affected, don't seem to care.
 
Time share closing company

Has anybody ever dealt with Savvy Properties, Inc. out of Bozeman, MT - I am dealing with a Craig Otte (email: craig.otte@gmail.com)...i was referred to them after donate for a cause couldn't accept my timeshare - any dealings with these guys??? are they legit? They are wanting an upfront fee and this scares me...
 
All An Up-Front Fee Buys Is A Listing On Some Semi-Bogus Web Site.

They are wanting an upfront fee and this scares me.
And they only reason for even going through the motions of doing the listing is so that they'll have something to point you to when you complain that nothing is happening with the sale of your timeshare after you hand over that up-front fee.

Lots & lots of people have learned the hard way about the futility of paying those up-front fees.

Nobody that I know of on TUG-BBS has ever reported any success in selling a timeshare via an up-front fee organization.

Learning the hard way is perfectly OK. Learning by reading & heeding is also perfectly OK -- not to mention lots cheaper.

Maybe the BOD needs to also be sued on a civil conspiracy theory, seems to me they should think about their fiduciary duty to the owners, not the cozy relationship with the management company.

If the HOA has no authority to do it themselves, which in most cases they do not, they certainly have no authority to delegate such a power to a management company.

A complaint to the state Real Estate Commission may bring a crack of the whip to cure this problem.

One of those multi-state timeshare closing companies operates out of that town. Is there a connection, I wonder?

Unless they have a legal basis in the Declaration, of course not. If this is one of the few timeshares with a genuine legal basis, it is a moral question, but in that situation, I would consider the amount excessive.
 
They have been very quick for me, but this beats everything in the past!

I just had a very quick and smooth closing with Timeshare Closing Services! I bought a Hawaii TS on ebay, sent in my contract about Jan. 6th and they probably received it in FL around the 9th. I was very pleasantly surprised when I got the recorded deed in the mail today - barely a month later! I think that's outstanding for a Hawaii recording!

Added - The seller was Mike Saylor/Vacation Innovations, Inc..

I won an auction (also Mike Saylor at VIN), on the evening of April 26, 2009. I sent my payment and deeding info online later that evening. On May 1, I received the recorded deed in the mail, which had been recorded on April 29, 2009.

There was an attached letter explaining a new electronic system that allows for electronic recording of real property documentation and that some county recorder's offices have implemented electronic filing. "This county office is more technologically advanced than many other counties." "TCS is one of the first closing companies in the timeshare industry to develop and utilize the technology necessary to satisfy the legislative requirements required for electronic filing in order to expedite recordings such as yours."

That was unbelievable to find the deed in the mail on Friday. Wow! :banana:
