Time Share Scams - BEWARE

Our dispute with the Mexican resort has been settled amicably. Thanks for all your advice.

The hard-sell and tricks they use at Mayan Palace are well known here. Often people come on, having been tricked into buying Mayan Palaces with the usual timeshare salespeople lies, and the usual advice here is to rescind the purchase before it is too late.

If you really want to give getting a refund of your money back, you might contact PROFECO and see what they can do. If the timeshare does not advise you of your right to rescind, then you have longer to rescind with no penalty. It might not be seen the same way where they did advise you of your right to rescind, but did not advise you that you could do so with no penalty.

Over the years that I have been a member of TUG I have read numberous stories like yours. Some have been fortunate and received total refunds after filing a complaint with the Mexican organization of PROFECTO ( or something close to that). I would think your best point is that they told you you could not reciend when you did have that right. I believe others have won on that point. It is so unfortunate these sales practices are allowed to continue. It gives a bad name to the timeshare industry and hurts the tourist industry in Mexico. The Mayan Palace resorts are the worst, but there are others that run a close second. Last year in Cabo we attended a MP sells presentation just to see how many lies we could catch them in. They have no shame.

Do you have this statement, with it PROFECO will get your refund, as it is illegal to do this.
 
Thanks for all the replys. We did contact PROFECO and filed a complaint. Their replies seemed to focus on the fact that we had not cancelled within the 5 days only, and not on the illegality of the sales tactics. I have filed complaints and made contact with numerous agencies since August after our final negotiations with Mayan Resorts. I can only assume they are still under investigation as I haven't heard much back. The waiver we signed was, of course, missing from our documents although the fact that we would lose our deposit was stressed enough times that it was all we could think about. This was our first experience with time shares of any kind. Mayan Resorts has offices in the United States and I am hoping that because of that they will be held accountable and stopped. My main goal at this stage, while waiting, is to warn others. I will continue my campaign. Thanks again for the input.

I am in the same boat as you... also got scamed in April, I also have a complaint filed with PROFECO, have yet to hear back from them... Also a complaint filed with the BBB of Houston.. no progress there.. Mayan just responded saying I was outright LYING that I did not sign a 5 day waiver clause.. again I did not have a copy of that like yourself...i would recomend going to www.contact@mayanresorts.org they are in the process of a class action lawsuit against the resort.... the webpage is just about the Mayan resorts SCAM.... I have also tried through MBNA (bank of america) to get a refund on the charges to my card... they basically said " tough luck" I will not give up on this... these people NEED TO BE STOPPED...if it is the last thing I do !!!! please feel free to email me with any other questions... or maybe we can work together somehow to get this solved and our money back...my email is

Thanks, Please keep us/me informed of the situation....and if you need any help let me know.... like I said before, I will take this place down.... and I am also in the process of contacting ALL major news corespondents ABC, NBC, CBS...
20/20 and 60 minutes, to bring this scam to the surface and try my best (like yourself) to expose this SCAM of a company... also involved with this is MBNA "Bank of America" that is who my deposit was charged to on a C/C .... and they have yet to help me... you would think such a "respectable" bank/company would help their customers involved with SCAMS... and also that they would make sure that the COMPANYS THEY do business with are LEGIT...please keep us posted
 
Tips on how to go about getting the word out . . .

Check out this link to a group which has been working away for years now, has produced and had broadcats documentary style interviews relating to the TS company involved (RHC). The moderators are pretty cool organizers and have been 110% promoting what you wish to do . . . so maybe it is time for everyone to get together to work together?

My story is the same, only the Sunset Group (Fishemen's Village) were the one's who got me. I am out $15,800 right now, and I am fighting it with my credit card. I would like to join any campaign to help innocent tourists when they travel to Mexico.

Harley Dude, if you need some back-up when contacting the news media, contact me. I own a resale company, Island Consulting Realty, and I talk to a lot of owners there. You're only scratching the surface. Anyone ever "trade in" one of their time shares and gotten "thousands" of dollars for it? Hmmm.....
Anyone realize that when you go to sell, the transfer fees will be so high you'll be lucky to give it away? Hmmm......
