I own a few resale contracts with Sunset Fishermen's in PDC. I purchased all the contracts through Holiday Group. I know quite a lot about the resort and about the sleazy sales practices of the organization.
I just purchase a contract in August for a two-bedroom odd year with an addtional maint. fee every 5 years. This contract was orgininally purchased in 2006. I knew this issue exsisted as it was on the ad and also on the purchase agreement.
Last week I received a new owners package with a billing enclosed in the packet for the 5 year addtional maint. fee, the problem is the billing was for a completely different contract that I purchased resale in 2005. This purchase agreement and contract did not have the addtional 5 year maint. fee. This contract was orgininally purchased in May 2003. It was for a 1+1 One bedroom sleeps 6 gold season even years expires in 2050. I do not believe the Sunset Group was putting that 5 year maint. fees in their contract in 2003!!! Can anyone help me out with this? When did you purchase and does your contract contain the 5 year addtional maint. fee? I believe the Sunset Group is manufacturing an addtional page to my contract as I only have 2 pages and Sunset is saying the clause is #21 on the third page of the contract and that all contracts have this addtional maint. fee. The studio contracts I have at Fishermen's do not contain this clause. Please help me if you can.
