Silverleaf Contract Rescission Need Help!

My wife and I "won" an all expense trip with airfare and hotel at a rock concert we attended yesterday. Caught up in the moment, we signed up for the meeting at the Hill Country Resort in Canyon Lake, TX the following day.

We attended the meeting and it was all too good to be true, caught up in the excitement of travelling and got suckered into buying a timeshare that was heavily discounted. It was for a timeshare in Branson, Missouri but was told we could use the bonus time any time of the "white and blue" weeks and convert our 1 week trip to RCI for $219 and stay anywhere in the world. We were sold.

Now back to reality and at home and started wondering if this was a scam. I researched online and found both positive and negative things about Silverleaf.

I have decided I just want to cancel this and have read about Contract rescission. My wife and I justed signed up yesterday but really thought it over and realize that we don't want to pay $900 a year in maintenance fees for something that isn't even guaranteed.

I have read a few threads on getting a contract Rescinded but would like to know if there is anything else I need to do. Any help will be greatly appreciated!

Get over to your local Post Office first thing tomorrow (Tues 5/27/2014) and send in your rescission letter via certified mail and cancel your contract.

There should be something in the package you received when you made your purchase.

If not, draft your own rescission letter.

It is very important that you send it via Certified Mail with Return Receipt and that it has a clear Postmark on it indicating the date you mailed it.

I had a friend that just bought at silver leaf and I helped him rescind. All recession information should be on the back of your two page main purchase contract. I believe that it was item #5 on the back of the contract. My friend followed the instructions and silver leaf was good with canceling their contract. Good luck!

Was it a Silverleaf resort in Texas? I was sold one in Holiday Hills, Branson, Missouri to would the letter need to be sent to them in Missouri or the resort I signed up at which was the Hill Country Resort at Canyon Lake, Tx?

Seldom, if ever, do you proffer to where you bought or where resort is physically located. Per preceding, just explicitly follow instructions in documents you received.

Also, be prepared for salesman to contact you as you are wiping out his June rent money!

I just read the contract and under EXHIBIT A it states I have 5 days to mail letter to Offices in Dallas. I already made a copy of all the documents in the contract which was 32 sheets. I will overnight certified mail with receipt.

There was no Contract Rescind letter in the forms. Is there a sample one that I can use to include?

Some outfits charge up to $50 for that stuff. I'd send it back by pack mule. Put in your letter 'Promotional Materials to be returned under separate cover.'

Some don't care whether they get it back or not. Silver Leaf, I don't know.

Glad you found us. Good luck, and after you get your money back, if timeshare still has some interest to you, c'mon back and we'll show you how to enjoy luxury digs at Motel 6 prices.

I really appreciate all the help! The contract didn't say anything about sending back the materials before the 5 days. I was about to send everything back vis USPS priority express but PO was closed due to memorial day. the contract only states to send back documents before 5 days so ill just overnight those and send the rest via regular snail mail to save some $. This for pointing that out

I was actually looking at renting timeshares which is actually way cheaper than buying. Motel 6 prices would be great!

Not necessarily. It depends on how you look at it. Of course, renting is cheaper than buying if you buy it from the developer (the way you almost did). You can find many resales for cheap or even free, sometimes with the previous owner paying closing costs and the next MF.

At times it can be cheaper in the sense that rentals are cheaper than what the owner is paying in MFs. You might be able to snag a bargain like this as the check-in date gets closer.

There are other advantages however, to renting. Some include:

1) It's easier to "get rid of" if you no longer want/need/can afford your TS.
2) You won't have to worry about what will happen to it, your heirs, or your estate once you meet your eventual death.
3) If you want to "exchange", you don't have to worry about the exchange companies' (RCI, II, etc.) membership or exchange fees. It is also usually easier to find what you want, when you want, where you want via a rental than through an exchange.
4) If you want a different sort of vacation that does not involve resorts (eg., camping trip, cruise, escorted tour, etc.), you won't have to worry about renting your unit out to try to recover your MFs. The same could be said if, for some unexpected reason beyond your control, you cannot travel that year.

Most of us here know what you mean but, JFTR, "recession", whose root word is "recede" usually means a dreaded downturn in the economy.

If you're looking for the noun form of "rescind", it's "rescission".
 
Going to overnight all contract, letter, and materials back to them today. Hope this works. Do you all know if I need to do anything about the RCI option included or will they cancel everything?

Should I call them to let them know that I am rescinding the contract and mailing letter and everything back? Should I call them tomorrow to see if they received anything?

I read on another thread just to mail everything back and not to make or answer any phone calls

1)You need do nothing about the RCI 'option'.

2)Do not call for ANY reason.

3)Good advice. Follow it.
 
I got an Inquiry Hit on my Experian credit file from the application process. They never told me they were going to run my credit. They just said autopayments from a debit card.

Can that inquiry be removed from my credit record so that it will not affect my credit rating?
