School crossing guard accused Tesla driver of hitting her – but doorbell cam footage shows SHE backed into front of his car

Tesla driver is arrested and thrown in jail after school crossing guard accused him of driving into her – but doorbell cam footage shows SHE backed into front of his car
  • A crossing guard accused Joe Hernandez, 32, of 'intentionally striking her leg (and) causing a minor injury' on September 9
  • A neighbor's security camera footage shows that didn't happen at all and Hernandez drove around the guard when she wouldn't let him pass
  • Hernandez was put in handcuffs in front of his girlfriend and her child and even spent the night in jail
  • All charges have been dropped but Hernandez's lawyer said the incident 'permanently tarnished' his reputation anyways
 
The doorbell cam footage strikes again in court this time Joe Hernandez was proven innocent because of a neighbor doorbell cam. IMHO.

And the police department / crossing guard is on the hook for a false arrest.

How would that be? Everyone that is found not guilty has the arresting officer/department on false arrest? At the time they believed an incident occured based on the evidence presented at the scene. Unless the officer knew at the time that the guard was lying and arrested the driver anyway, there is no false arrest here.

He was not tried, the charges were DROPPED. The arresting officer was acting on a complaint of "Failure to render aid" by the crossing guard. That is, I assume, a form of hit and run.

If I read the article correctly, the crossing guard is employed by the police department. If she is and gave a false statement which led to his arrest, that puts her employer on the hook too. In civil court.

She may face criminal charges for making a false police statement.

I suspect this article was fished out and presented simply because of the vehicle driven. People are accused of things they don't commit every day. When the accuser fails to prove their point or is shown to be wrong, the case dissolves. Poof.

If it were a citation, I would agree. Arrested, spend a night in jail ... not so much.
 
And if that footage never came to light? Need to punish the false accusers so the real ones are believed. Hopefully fired, jailed and sued.

If you look at the video, there is another woman who I suspect is a police officer:
The driver, whom they identified as 32-year-old Joseph Hernandez, then fled the scene, police said. A nearby officer noted the driver’s license plate and Hernandez was arrested.
This happened right in front of her. She could have ordered him to stop if there was an injury. You see her approach the car.

My opinion: They collided to jam him up because they didn't like his attitude --- and got caught.

Correct. This guy's life could have been ruined, everyone would believe the cops, and there would have been no recourse. Being government employees, this is a civil rights violation.
 
This is why dashcams should be standard equipment on all vehicles.

The funny thing is that all Teslas come standard with a dash cam, you just need to plug in a formatted usb drive. It's crazy that this driver had to rely on doorbell footage so I hope they learned their lesson and figured out how to use the dash cam.
