Resort construction during my fixed weeks

Red Wolf Lakeside Lodge, Hanalei Bay Resort, Sweetbriar Lake tahoe, Marriott Canyon Villas, Hyatt High Sierra, Point at Poipu
Brockway Springs Resort in Lake Tahoe charged us a special assessment to replace unit decking (2 attached wood decks) and did the construction over a 8 week period from September-November. Those who own those weeks (memberships are 2 or 3 weeks) could not use or trade their weeks but still had to pay the maintenance fees. They also would not provide any other weeks to use. I would have been happier had all the owners been impacted evenly but those who own outside the Sept-Nov time period were not impacted at all, except for the special assessment which everyone paid. I asked the resort for other weeks to use (we own 2 weeks) but they refused. There is nothing in the resort rules that addresses this issue. Has anyone experienced this situation at another resort and did you get any refund for unusable weeks.

If you own a fixed week and work occurs during that week you are out of luck. Moving the work to another week simply changes which owner "pays the price" of no use. It doesn't solve the problem. The same thing occurs with float ownership when work closes units except the last owners requesting time are the ones who lose - someone still loses. Unless there are dedicated maintenance weeks provided for (many resorts DO have that) if you are unlucky enough to have your week be the one that gets closed its the luck of the draw. Now the NEXT time it should be a different group of weeks or you would have a complaint.

Do you think a resort would ever do renovations like this during the prime summer weeks?
