The key question for ANY closing company is
are they licensed in the state where the timeshare is located?
From my recollection, the attorney who runs this operation is licensed to practice law in a state other than Montana (Colorado, I think - check the state bar listings) and would certainly be qualified to do closings in the state where he has his law license. Unless he is licensed himself in other states or associates duly licensed attorneys in those states, then that is another matter entirely.
The North Carolina State Bar has issued cease and desist orders to many of these out of state timeshare closing companies. I have not seen the exact list of which companies, but if one is looking for a North Carolina closing, you can check with the NC State Bar to find out.
Indeed for any closing company, I would ask the name of the person who will prepare the deed. Then I would call the State Bar of the state where the timeshare is located and ask if that person is licensed to prepare deeds in that state. If they are not, then run, don't walk, away from that closing company. If they say it is ''attorney reviewed'' ask the name of the attorney and ask the same question.
Many State Bars publish their membership lists online, so you may well be able to look this up online.
If one of these closing companies comes up with a draft deed that shows either the buyer or seller as the one who prepared the deed, then that is a huge red flag that the closing company is trying to circumvent state licensing laws. Companies deliberately trying to circumvent the law are companies that you should be especially wary of. Violating those licensing laws is a criminal offense in many states, and they are setting the buyer or seller up, at least in theory, as an accessory.
Anyone have any dealings / experiences with Resort Closings, Inc. They are licensed bonded and insured.
Thanks.
