My rescind letter, sent certified with return receipt to the address specified in the contract, was just returned to me: "Attempted - Not Known - Unable to Forward".

Has anyone ever heard of this happening before? I don't know if the post office didn't like my hand writing, the intern picking up the mail didn't recognize the parent company name, or if the contract had an old outdated address.

I think my next steps going forward are:
1. Keep the original letter unopened in a safe place as evidence.
2. Contact the company to confirm the address in the contract is correct.
3. Resend the rescind letter (with copy of certified mail receipt) as a simple 1st class letter without signature required.
4. ???

It would help if you tell us what company you are dealing with. Maybe someone here will have the most recent address on record.

I would do item 3 plus standard mail. So send one copy certified mail, and one via ordinary mail. For both letters, include a photocopy of the envelope that was returned to you.

Sapphire Resorts; AKA: Starpoint Resort Group
(originally incorporated as GeoHoliday Club)

The contract listed the rescind address three times in the contract with slight variations for the attention line. Any of the variants from the contract should be accepted, right?

I doubt the c/o or Attn had any issue on delivery. It would be the actual mailing address that would be the issue. Was the actual address the same in all three places? Did you put the attn or c/o line after the first line of the address?

What I would do, if you are now outside the recession period. Write up a new letter and explain the situation and that you had mailed the rescission letter in the allowed time. Verify the correct address for mailing or just send three letters. No need to send them all via USPS Certified Mail. Send them all via USPS First Class with Certificate of Mailing. This will be much cheaper. Less than $3 per envelope. Send your new letter along with a photocopy of the original letter, envelope and receipts you have from USPS to prove the original date you mailed the letter. Send it in triplicate to all three attn and c/o. If there are variations of the actual address, send it to all of them.

3. Resend the rescind letter (with copy of certified mail receipt) as a simple 1st class letter without signature required.
When you do this, as I noted in my last post, use a stamp. An actual stamp you stick on yourself. Not something the post office prints for you. Then also request a Certificate of Mailing. This will be your proof of who the envelope was sent to, who it was from and there will be a postmarked stamp on it with the date.

@StarSailer : When you send out some additional rescission letters be sure to provide them "a copy" of the original tracking number so they themselves can look up and see the tracking number and the fact that the USPS did return it to you. One less item for them to claim denial of your actions!

Keep us posted and best of luck!
