Won ebay auction for 35000 BG points ($400) with free closing/transfer. Listed as Georgia Massachusetts timeshare. Asked for estoppel and they said no citing privacy. Asked what the home resort was and said it was 3 weeks in Petit Crest Villas and 1 at Breakers. Both of which are Club Associate and not Club resorts. Figured BG bought units at them then sold weeks. Completely possible I think. I get the Sales contract and resort it listed as Bluegreen Vacation Club, anniversary and points allotment is listed, price, as well as names and addresses. No mention of underlying weeks or maintenance fees, only that they are due 8/1/14. Contract and payment have not been sent. They also want money (sent paypal invoice) sent to them instead of closing company who they are probably in bed with. Requested estoppel and closing company info and its likely VP Title but they haven't responded yet. Bottom line is no estoppel no sale. I'm also going to request they call BG and allow them to give me info or is that to much? They say they have POA. Am I in a position to request using my own closing company at my expense? Should I give it a chance or bail? I know it's eBay but it is still a contract to buy isn't it? Every so often I am blind to little red flags. This has been one of those weeks. Thanks for any thoughts and advice.

Worst reputation seller that is still operating under the same name. That might be better than the MacMillan outfits that change entities and fake owners with the wind, but not much better.

After finally closing a deal with CJ, this is the only mass eBay seller that I have not successfully purchased from.

The short version of my advice, since you've asked, is that you should not do business with this entity at all in the first place and that you should just lace up your running shoes and sprint off in the opposite direction --- right now. The track record of this entity is very well established and it ain't pretty.
A simple TUG search on the company names will provide you with much more "input" than you'd likely care to even digest.

The longer version of my input is that no, you are not in any position to request or demand the use of your own closing company in a PCC's eBay auction.
And no, it's also not a "contract" as a mere (non-binding) eBay timeshare auction you've "won" (...hardly a "win" when this PCC is involved, but that's not the point).
And no, BlueGreen is not going to cooperate with a PCC who, as far as BG is concerned, is not the owner in the first place. BG does not care a whit about a PCC's PoA. The PCC surely already knows this fact and would not likely bother to call BG as an unwelcome, non-owner "intermediary" on your behalf.

The "privacy" excuse to your estoppel request is a bit lame. As a PCC, they probably haven't even bothered to obtain an estoppel in the first place --- and likely won't. The PCC is not the owner of record, but merely has PoA, so the PCC doesn't particularly care anyhow; they wouldn't be the ones "on the hook". If they have estoppel documentation in possession, they could simply redact (black out) all of the owner identification details and provide you with a redacted copy, minus that owner identity.
"Privacy concern" is a handy and convenient excuse, but just doesn't cut it as a credible reason to fail / decline to provide estoppel documentation, even if redacted.
You shouldn't care about current owner's identity anyhow; all you really need or want is verification of the accuracy of the "advertised product" and the current financial status of the current (real, underlying) owner's account, as directly reported by BG, under recent (and specifically dated) BG authorized rep's signature.

IMnsHO, it would be a waste of your time and effort to deal with either this PCC or these assorted issues. Take a breath, turn around, run away and keep shopping.

What theo says is true of eBay real estate auctions.

For all the reasons stated, run away from this one. They will ban you from bidding again on their auctions but that's a good thing.
 
I talked to eBay about it last night and will be contacting them and cancelling today. Normally I wouldn't even have bid without the estoppel and other info. Just couldn't help myself. Guess all I could see was points points points.

I can say I am banned from red weeks 4 less auctions on ebay and yes when search for timeshares I want they always have what you want but heer me I would never give my money to anyone for a purchase that involves a contract (when time share for less) and cannot even fill in the blanks to make sales . So answer this for your self
Do you know or trust them to make this deal on a hand shake or even less?
Do you know if your money is in escrow account?
Is this a great deal if it goes through and worth the head ache or loss of money

Like I say I am band from there ebay actions but when I asked to protect me and my money they just turned and ran from me so I must be the dumb person that will never buy anything from seller / company / closeing company / best friend that operates in the dark myloss
 
Sent cancellation request. Was going to offer up their reputation as the reason but eBay said not to. Reasons I sent were unacceptable details of the Sales Agreement, not Sending Estoppel with sales agreement so I could verify the timeshare and more payment being made to a by me to a reputable escrow company. I had the customer service representative (Vivian I think) at eBay Google redweek4less and IA Vacations while I was on the phone with her. That way she could see for herself why I wanted to cancel. Also said that if they file a non-paying bidder complaint to call back and it would likely be removed. Also offered up they would have a team investigate them for what that's worth. Redweek4less and IA will probably just change the names if anything does come of it. Back to looking for BG points. Lesson that I had to relearn ALWAYS, ALWAYS check TUG! Site is so awesome as are the members. Thanks all.

That Bluegreen listing was definitely poorly done and you have every right to refuse to complete the sale.

However, redweek4less must be doing something right. In the past 3 months he has 52 sales over $1500 with 10 over $7000. One at $15,200. He must be doing something right.

They've been playing the PCC / PoA game (...ineptly and poorly, but apparently quite successfully) for a very long time now, with no such name changes.

Your eBay real estate "win" was non-binding anyhow (and eBay knows that), so no reason to offer any lengthy or elaborate explanations for not proceeding.

Your eBay user name will likely now be "blocked" by this shaky seller --- but just consider that an unexpected early Christmas gift from them to you. :rolleyes:

I won an Ebay auction from them a few months ago for a Grand Timber Lodge winter ski week. They sent me a contract which I signed and sent back and I asked them to sign the contract and send it back to me but they refused to do so until I sent them the money, which is insanity since we didn't even have a contractual arrangement at that point. They said it's their policy to not give the buyer a signed contract until the buyer has paid. I refused to do so and they canceled the sale. They also told me that the resort did not have a first right of refusal on the sale and I called the resort directly and learned that they did in fact have a FROR. So, my deal never went through and I have not bid on any of their auctions since. I've noticed that their auctions bring a lot lower price than others for the same product but I don't think it's worth the risk or aggravation to deal with people like this. I don't mind that they require you to use their closing company as long as you can pay with a credit card. These resellers make a big part of their profit on the closing cost and you factor this into what you're willing to bid but I think it's unreasonable for them to not send you a fully executed contract before requiring payment.

Something similiar happened to me, took almost a year to close on a Marriott. I am also banned from their auctions. Seems like redweeks for less, wwpt, and a few others are all in cohoots with each other. :annoyed:

Sad to say redweek(s) for less is a different outfit but the reputations are similar to that million entity umbrella.
