Run, run away...
Won ebay auction for 35000 BG points ($400) with free closing/transfer. Listed as Georgia Massachusetts timeshare. Asked for estoppel and they said no citing privacy. Asked what the home resort was and said it was 3 weeks in Petit Crest Villas and 1 at Breakers. Both of which are Club Associate and not Club resorts. Figured BG bought units at them then sold weeks. Completely possible I think. I get the Sales contract and resort it listed as Bluegreen Vacation Club, anniversary and points allotment is listed, price, as well as names and addresses. No mention of underlying weeks or maintenance fees, only that they are due 8/1/14. Contract and payment have not been sent. They also want money (sent paypal invoice) sent to them instead of closing company who they are probably in bed with. Requested estoppel and closing company info and its likely VP Title but they haven't responded yet. Bottom line is no estoppel no sale. I'm also going to request they call BG and allow them to give me info or is that to much? They say they have POA. Am I in a position to request using my own closing company at my expense? Should I give it a chance or bail? I know it's eBay but it is still a contract to buy isn't it? Every so often I am blind to little red flags. This has been one of those weeks. Thanks for any thoughts and advice.
The short version of my advice, since you've asked, is that you should
not do business with this entity at all in the first place and that you should just lace up your running shoes and sprint off in the opposite direction --- right now. The track record of this entity is very well established and it ain't pretty.
A simple TUG search on the company names will provide you with much more "input" than you'd likely care to even digest.
The longer version of my input is that no, you are
not in any position to request or demand the use of your own closing company in a PCC's eBay auction.
And no, it's also
not a "contract" as a mere (non-binding) eBay timeshare auction you've "won" (...hardly a "win" when this PCC is involved, but that's not the point).
And no, BlueGreen is
not going to cooperate with a PCC who, as far as BG is concerned, is
not the owner in the first place. BG does not care a whit about a PCC's PoA. The PCC surely already knows this fact and would not likely bother to call BG as an unwelcome, non-owner "intermediary" on your behalf.
The "privacy" excuse to your estoppel request is a bit lame. As a PCC, they probably haven't even bothered to obtain an estoppel in the first place --- and likely won't. The PCC is not the owner of record, but merely has PoA, so the PCC doesn't particularly care anyhow; they wouldn't be the ones "on the hook". If they
have estoppel documentation in possession, they could simply redact (black out) all of the owner identification details and provide you with a redacted copy, minus that owner identity.
"Privacy concern" is a handy and convenient excuse, but just doesn't cut it as a credible reason to fail / decline to provide estoppel documentation, even if redacted.
You shouldn't care about current owner's identity anyhow; all you really need or want is verification of the accuracy of the "advertised product" and the current financial status of the current (real, underlying) owner's account, as directly reported by BG, under recent (and specifically dated) BG authorized rep's signature.
IMnsHO, it would be a waste of your time and effort to deal with either this PCC or these assorted issues. Take a breath, turn around, run away and keep shopping.
