For anyone that has used a Redweek Rental Agreement => does it limit the liability (wrt renter/guest personal injury, loss, damage, etc.) of the owner renting the timeshare unit? As per a section taken from clause 9 taken of the Redweek rental agreement below, Redweek is clearly protected, however I am not seeing the same limitations for the owner of the T/S being rented.

9. LIMITATION OF LIABILITY
REDWEEK SHALL NOT BE LIABLE FOR AND DOES NOT ASSUME ANY LIABILITY OR RESPONSIBILITY FOR ANY LOSS, DAMAGE, THEFT, DELAY, DEATH OR INJURY TO ANY RENTER, RENTER'S GUESTS, ANY OTHER PERSON OR PROPERTY ...

Koala has $1,000,000 liability insurance for owners, when you rent your week through them. I wish RW did the same.

Did you have a problem with a renter causing damage?

Thanks for the Koala reference.

I have had no issues in the past … I don’t rent that often. I just wanted to ensure that I was covered as the potential liability far exceeds the nominal rent amount. When I used RedWeek in the past, I used my own agreement for the renter to sign protecting me for any liability against personal injury and property damage. With RedWeek’s new rental process, they no longer allow you the “do it yourself “ rental process. The RedWeek agreement (for both parties to sign) appears to fall far short in protecting the owner vs what I had my renter sign.

What about liability against personal injury that a renter/guest incurs while renting your week. Do you know if that is also covered within the Koala insurance policy.

Thx.

BTW … if anyone has other recommended rental sites, that would be appreciated.

Thx.

You can replace it with your own contract.

Terrific ... great to know. I suspect it may be easier to add my clause or modify wording protecting the owner to their agreement.
Yes you can use their contract as a base, then customize to suit yourself.

You can replace it with your own contract.
As a follow-up with Redweek => the general custoemr service person advised that the agreement cannot be modified. Perhaps they is a specific group I should be addressing my request with?

You sure about that? With the new model, I was under the impression that you were stuck with Redweek's clauses and provisions of their contract. There's really no way that I can see that you can somehow have the renter sign YOUR contract, as it's all through redweek now.

I have another call into RW to discuss with someone … although I am not optimistic for a callback.

Given the volume of rentals on their site, I can’t be the only person with this concern.

I wonder if now that all payments and contact with rentees have to go through Redweek, wouldn't they now be considered the renter of the property?
