Theo is right. I actually had a real estate closing, a 100k house the owner no longer could afford. The owner had a private money loan on the house and went to the clerk of the courts office and deeded the property unknowingly to the lender.
We had to draft and file several affidavits in public reocrds saying this was done without lender knowledge and that delivery and ACCEPTANCE were not done and that the lender did not accet the deed.
I can tell you, the owner still owns and the lender is foreclosing on the property do to some liens on it.
You just cant give a deed cause you no longer want it..... There are usually certain things like consideration given ($$) delivery of the deed and acceptance by the person that is supposed to receive it.
