Could others share their thoughts on this? I am not talking about eBay but rather outright purchase directly online, placed on a shopping cart and checked out just like a regular purchase for personal items or goods. Real Estate contracts are covered by the Statute of Frauds which needs to be in writing or it is unenforceable. Moreover there are issues when the party is married and community property is involved. Other disclosures are required as well in purchase contracts involving timeshare interests in certain states.

Are you referring to a website like Sunday Vacations? I have used their shopping
Cart and purchased from them.

No matter what the online interface is, you are still required to transfer the timeshare using a deed that meets the legal requirements of local law, and then is recorded with resort management. The easiest way to be sure that happens, is to use a reputable closing company.
 
But they already have the full purchase amount. The money does not go into escrow. Ebay purchases are not binding by virtue of its stated policies.

It is really non binding until you send them money. If you send them money, and you want to cancel, then the only way to somehow cancel would be to sue them for the money you gave them.

I have, also. It was one of the smoothest transactions I've ever had.

Assuming that you are talking specifically about timeshares in the first place (...sorry, but that's unclear to me from OP fist post), are you stating that payment in full is made before a purchase and sale contract is even prepared, viewed, approved and signed? :eek:
 
Yes. Timeshares. I have no doubt about the credibility of Sumdays. Just wondering about the legalities of shop carting an interest in real estate purchase, and its binding effect as set up by Sumdays. Purchased before any paperwork is signed. Of course, minimal amount. And yes, I am biting my nails. I'm a typical OCD tugger after all.

If they can't deliver what is advertised, they will refund. If you tell them you changed your mind after sending the money but before signing the contract, they will refund. If you live in Florida or are purchasing a week in Florida, even after signing contract and sending money you have 10 days from the contract signing to rescind the purchase.

They do have auctions on ebay at the same time they have weeks available on their website and it is possible that an ebay auction can end (and the week would no longer be available) but it would still show available on their website and the system would allow you to pay for it. In that case depending on whether it happened during the week or weekend, it could take 1-3 days for Sumday to tell you the week is not available and then refund you payment.
 
If indeed it is SumDay at issue, they certainly have a track record of reliability and of making things "right" if the transaction goes awry for whatever reason, either at your end or theirs.

I certainly wouldn't be as comfortable with many (if any) other Internet-based resellers.

While I don't know the legalities, I did buy a 2 bedroom Carlsbad Seapointe from their website for $299. out the door. I got exactly what was advertised in a very timely manner. I wouldn't hesitate to buy from them again.

My Story with Sumday!

I was searching for bonnet creek on ebay 300,000 plus points. After reviewing tug talking of the good sellers on ebay, sumday kept popping up. I went directly to their website and found a 346,000 udi in bonnet creek for 8k.

I email sumday and asked if there was room for negotiations? The reply was "Always, What are you thinking of offering" I reply with all in including deed and resort fee $3500. The sumday rep reply they can make that happen, when are u ready to buy?

I replied with call me at x #. She (Pam Albro) walked me to the website. She changed the price. I refreshed my browser and added the $3,500.00 payment to the cart.

I paid with my amex (for safety). After that they emailed me the purchase paperwork for the transaction. In that paperwork it did discuss our 10 day to rescind.

My purchase with jan 13th, deed was recorded yesterday, now just waiting for the wyndham transfer.

I can understand people being skeptical with all the crap that gets thrown around by some timeshare sales, but I was very, very pleased with sumday and very thankful for the people on this forum for the free education on timesharing!

The transaction likely isn't binding, but since they have your money from the cart shopping, your only way to probably get it is to go to court. I don't know if a credit card company would approve a dispute in your favor.
