I'm in a dispute with Celebration World Florida over a fee that was charged me a couple years ago. They charged me $250 a couple years ago for a Special Assessment. The Special Assessment was later rescinded. Instead of returning my money, they wanted me to use free days instead. I did not want to do this, as I trade with RCI. I would have preferred them returning my money, but they didn't want to do this. So I deducted the $250 from my yearly maintenance fee. they didn't agree with this either. Now they have turned me over to a collection agency. Has this happened to anyone else, and do I have any other options? Any assistance would be greatly appreciated.

The SA's and MF's are separate accounts, the funding of which is not 'sposed to be intermingled. Unilaterally shorting your MF's was not a good idea.

I say, pay the MF's and have an attorney write a demand letter for the refund or sue them in small claims court.

Note: This is not to be construed as legal advice, merely the musings of an armchair quarterback. Nothing more. For legal advice, you need to consult a qualified attorney.

Withholding partial payment of you MF's was a bad move. You had no legal standing to do this and, they have a valid claim against you. Likewise it sounds as if you have a valid claim against them for the return of the $250 but, it is a seperate issue.

I would contact an attorny and see about starting a collection action against them, then negotiate the ceasation of collection attempts against you as well as restore your credit record to show that it never happened.
