Your comment about being bullied resonates with me. It's 81 dollars. He asked you to take the ad down. Stand your ground! I agree with others. Send only one email stating your position. Ignore every other email, but save them. You may get $0, but he loses $419.

Had you told us that he changed his mind a day later - you hadn't taken down the ad - he sob storied (true or not) about losing his job - I might feel differently.

TR you're correct I forgot one minor detail in my scenario. The agreement would be that he gets the $419 back "IF" you get your $81 and close the escrow.

Thank you everyone for your support and advice. I don't take it lightly and I wil hold true to what my gut has been telling me- to hold firm in my stance against being bullied. Thank you so muh again!!

I don't think you can resell your timeshare unless this escrow is cancelled and this buyer releases the sale from escrow. In other words, you can get another buyer, but right now there is a "cloud" on the title.

Agreed - this flake could keep you from dealing with a committed buyer by clouding your title. I know it might feel better to hold your ground, but practically speaking it might not be the best thing to do in the long run. In Texas and I suspect in every state, it is almost impossible to prevail against a buyer who no longer wants to buy. Sometimes it is better to just chalk up your losses and move on.

The only legal action that would be worth even considering would be small claims court, but you would have to check on jurisdiction (i.e would you need to file in the country of the timeshare, in your county, in the county of the escrow agent, etc.?). Again, this might be end up being more trouble than it is worth while it ties up the sale of your TS to a real buyer.

Okay, now lets into the real world.

$81 is not a significate chunk of change. Your "buyer" played a head game on you by demanding you remove the ad off Redweek. By agreeing, the "buyer" saw this as they might be paying "too" much for your timeshare or it was worthless OR a hundred other reasons that idiots (or their friends) come up with. You felt that the "buyer" perhaps jerked you around.

You are NOT a PRO at selling - stop kicking yourself. Release the funds, close out the escrow, and just learn from this experience. You could/should have used all this energy on a new listing with great pictures or research another internet outlet.

Karma is a great thing in the universe, IMO. Keep yours at peace and a better buyer will appear ... even in this low market. Life is too short and having a heart attack for $81 :doh:

I beg to differ. The existence of a sales contract in itself puts nothing on the record to "cloud" a title. That could happen if the buyer were to sue the seller for performance of the contract and record a notice of lis pendens (pending litigation). But as of now, nothing on record clouds the title.

The seller should, however, be aware that he's dealing with a buyer who's ignorant enuff to be dangerous, and there's no telling what trouble this guy might try to stir up, if he gets wind of a new sale. It'd be far better to be rid of this nut-job, first.
