I just snagged a 2 bedroom EOY unit at Kauai Beach Villas on ebay for $1. :D
Have been looking for an even EOY there for the last 6 months.
Does anyone know the whether there is a ROFR in the Wyndham contract, or whether Wyndham has been exercising their ROFR's recently?
It may be too good to be true, but I couldn't pass up bidding on it.

No, it is not beachfront. So, if yours is, I would conclude that $3 is still a better deal. ;)
I have read about the Pahio ROFR on post 7/1/05 contracts, and that's why I was wondering if anyone had heard of recent instances of it being exercised.

Another point of confusion is regarding whether all units at KBV are managed by Pahio, or whether there are some under Wyndham management, or whether they are one and the same? My understanding regarding the post 2005 ROFR clause is that it pertained only to Pahio contracts.

I have no facts but suspect that many/most KBV weeks owners have not converted to Wyndham points. I am surprised by the number of owners (significantly more than zero, but a minority) I meet there who have converted, so I am not sure. Converting only makes sense to me if primary intent is to trade, so I don't expect to meet Wyndham points owners at KBV who own at KBV.
That aside, Wyndham is the only management company for the timeshare units (105 timeshare /150 total condos).
Pahio did not allow RCI Points to be resold - those resales reverted to weeks. I am not sure whether there is ROFR on Wyndham points resale, but they would all be after 7/2005. Developer sales at KBV were mostly or entirely complete (sold out) by the time Wyndham bought it. Bali Hai is still in developer sales.

Congratulations!

I just received the confirmation for our 2010 reservations for our preferred unit, and we will be making our 2009 visit in about 6 weeks. We are very happy with KBV.

I wish I had known you were looking - I was recently offer an eoy ocean front unit for a very good price.

Oh - and the reseller is still trying to find a replacement for the 3rd week we bought around Christmas, that had title problems.

We feel like we about to join a really special club. I guess it's a good sign that no one has posted about recent ROFR experiences. It does seem like so far every thing is above board, with reputable seller, and reasonably accurate info. But I'm not holding my breath, with ebay, who knows what might happen.

Pahio ex-owner who is still hanging around somehow working for Wyndham has tried to sneek in ROFR to unsuspecting resale purchases. Getting away with it in some cases. Not with informed resale purchasers. David, might be his name, but I am not sure.

Wyndham can't even be bothered with the ROFR, It would actually be cheaper for them to buy resales then to build new resorts, but hey then we wouldn't get any new locations.
