Own several weeks what happens if I stop paying maintenance fee on one of my weeks

Fort Lauderdale Beach Resort-Weeks 4, 5, 6, 7, 8, 9 and 44
Asking for a friend. They own several winter weeks and one off season timeshare week at the same resort. They plan on stop paying their maintenance fee on the off season week as they do not use it. What happens to their usage on their winter weeks if they stop paying the off season week maintenance fee.
 
They will have to read their contract. In my case, if you default on one, they lock you out of all properties until you are current.

That is what I tried telling them. But they think they will be okay with their other weeks. They are an older couple and not concerned with their credit rating, but spend most of the winter at this resort. I think they are going to get a surprise when they try and use their weeks next winter.
 
Is the resort not willing to do a deed back? Who is the resort management company?

They said they do not want to a deed back as there would be 2 years maintenance fee payment required. They are just going to stop paying their maintenance fee next year. The management company is Vacatia. I know they do deed backs but require 2 year maintenance fee. These people do not care but want to continue to use their other weeks.

I would think if they want to ensure usage of their other weeks, then deeding back with two years of fees seems reasonable. I guess if they lock them out of the other weeks they could just pay up.
 
Just clarifying it is not me, my ownership looks like it is me, but I always will use my week 44. It is somebody who is an owner as the same resort who asked me and we were talking.

Vacatia is the management company for The Fort Lauderdale Beach Resort.
I don't know what "off-season" is for the Fort Lauderdale Beach Resort but I'm pretty sure off-season there is better than the same time of year at a lot of locations. I'd try renting the unwanted week. It's not that hard. List on RedWeek.com, TUG, Koala, and maybe eBay if they really get into it. I'm betting they get some hits.

But, I can all but guarantee that if your friend stops paying on one contract, they'll have a hard time staying there the other weeks. They have a very bad and delusional plan.

It might very well prove to be “penny wise and pound foolish” if those folks are denied access to their other owned weeks after being unwilling to pony up for the legitimate deedback of that one unwanted week. They likely cannot “have their cake and eat it too”, despite wishing for it to somehow be otherwise.

Each to their own personal decisions and choices, I guess…:shrug:

They have their minds set on just not paying. I have tried telling them the consequences, but they are not interested in listening. They are an older couple and someone advised them to just stopping paying for that week

Yeah, with my resort group it goes like this:
  1. Lock you out of online reservation system
  2. Collection calls start
  3. Calls to make reservations are routed to collections
  4. IDK if existing or standing weeks are cancelled, but I would suspect that notice would be sent that those weeks would be put "up for grabs" at some point

How do they even delineate which weeks they are paying for and which they aren’t? This sounds like a way to eventually get all their weeks foreclosed on to me.

The Vatica website has all your ownerships listed and select the week you want to pay and payment gets posted to that week. I own 7 weeks and I have 7 weeks listed on my payment screen. I select the units I am paying
 
Depending on how the contracts are written and what the governing docs say I could still see this leading to foreclosure of every week they own. Consider the scenario where they owe multiple years of maintenance fees for one of the contract. The HOA forecloses on that week but because of the value of timeshares there is no money generated from the foreclosure auction that leads to satisfy that judgment. I’d bet the contracts are written in such a way that all of their weeks will be subject to foreclosure, not just the one.
