Original owners getting preferential treatment on making reservations?

Just checking to see what is legal on resorts allowing original owners to book units 13 months out and all resale units can only book out 12 months.

Is this legal? How will it effect the resort?
 
Every resort system has its own RULES. Plus, what was valid 15 or 10 or 5 years ago, MIGHT not be valid for a new owner or a resale buyer today.

Too general of a question for the REAL info you seem to want.

And inside of a system, different resorts would have rules differences, too. Like some Wyndham resorts have either FRIDAY or SATURDAY as a checkin day .... then there are other Wyndham resorts which include SUNDAY as a checkin day. And other resort chains, there might be just ONE day as the checkin day.

So, who can book when based on direct buying or resale buying ... not a general answer. But that could change tomorrow.

PS Wyndham points system do NOT currently have different booking windows for direct buyers vs resale buyers.

On what grounds would it be illegal?

A resort / system can make its own rules.
 
What system?
Westgate has rules in place for some of it's new resorts where resale owners have to wait 60 days before check in to book at their float week home resort while direct owners can book 12 months in advance. At 60 days almost nothing good would be available and it restricts exchanging as at that point unless you can deposit same day you would be restricted to flexchange only with II.

... as well as the specific contract terms allegedly now breached and the new documents / policies which reflect adverse changes since contract execution.
In any case, it's probably safe to speculate that a resort or system changing its' internal reservation / operating rules is highly unlikely to be "illegal".

It is possible (but unlikely) that reservation procedures and time frames are specifically addressed within the initially filed CC&R's (or deeds), so in the absence of any such duly recorded procedures, any and all such procedures can be later adopted and / or changed (...just take a look at what Westgate has done "after the fact" to Westgate resale buyers to change the rules of the Westgate reservation game on them --- or I should perhaps say to them). :annoyed:

Not just helpful, but necessary. There are too many timeshare systems all with different rules.
Personally, it sounds to me like a typical sales lie they tell to get you to buy from the developer instead of retail.

It's probably legal. Ethical? no, but legal, yes.

Yes, I have a fixed week contract that allows Friday or Sunday checkin (not Sat) and so I have to specify the checkin day in advance in order to guarantee my week. It's extremely frustrating how they can change the rules here and there and essentially block out some owners.

Changing the terms of the original contract.
I think the legal analogy would be if you bought a house in a community that has an HOA. The HOA rules change as time goes on and so new owners have to follow the current rules whereas some older owners might have certain things "grandfathered in."
 
Except where those rights are vested in a deed, rules cannot change those rights.
