No Recorded Deed for Timeshare (BlueGreen)

Hey folks, I am a timeshare owner for about 13 years. We recently had a death in the family and needed to remove my sister-in-law from the deed and replace her with another member of her family. In following the steps to have that done I found that Blue Green Resort in Myrtle Beach did not record the deed for the week purchased. Is there something wrong with this picture? In researching the court records in Horry County I found other deeds registered even the week before ours but nothing on our week. As a matter of fact, corporate could not even find our contract and I had to send a copy of that to them. Any thoughts anyone?

Sorry that no one has responded to your question yet.

I think you may get a response in the buy and selling board. So I'm moving this thread to there.

Now for a response. TS prices are at an all time low. This timeshare may not be worth anything at all.

Also not all TS are deeded. Bluegreen is a point based TS system and may not give their owners a deed. (two of my TS are this way)

What does Bluegreen have to say?

Do you have a deed or just a contract to purchase? Almost always deeds are recorded, but one dosent have to be recorded to be valid...Does Bluegreen contest this contract or deed, or do they recognize it as their act. Have you and your family been using the timeshare?

It dosent sound as if there is any intent here to deny your ownership...just an oversight (13 years ago). If you have the old deed, just prepare a new one and record it, and present it to Blue green to up date their records. If you dont have a deed; just the contract, my guess is that Bluegreen will sign a new deed and you can record it.

Not all Bluegreen transactions are deeded weeks. In fact, most of thier transactions are points based where you get your allotment of points to use at any one of their resorts.

If that is the case, the deed resides with the Vacation Trust and the owner is given the points to use every year. If it is a points based contract, the deed is recorded into the name of the trust and not the individual owner.

Some resorts have both deeded weeks and points weeks. I would say that most of the Bluegreen transactions are points based.

I own deeded property at a bluegreen resort, and I suspect the op does too. Even if its not deeded he has a problem in that Bluegreen cant find his contract.

The resorts in South Carolina and all of Bluegreen have both deeded owners and club owners. Club owners will not find a deed in public records in their name, they will find the the deed in the name of the Club which is Vacation Trust Incorporated. There are over 2000 records in Horry with that name.

As far as the contract, no one is dismissing it. The first question I would have is WHO does Bluegreen recognize in their system as the owner. If it is the existing person, then the contract may be in storage, it may have been imaged, it may have been plain old lost. The fact that they can not find the contract does not concern me as much if they show them as the owner.

Just like banks lose original notes in foreclosures, maybe the contract was imaged and something happened to it, maybe the call center can not find it on their online system, maybe in it is storage somewhere.

If they have a points contract (Club) then they have an OBR for their beneficial interest in the trust. Those are not recorded in Public Records like your deeded week would be.
