If you have purchased or sold a timeshare in Whistler, would you please let me know if you have worked with a notary or attorney you would recommend?
This is an owner-to-owner transaction for a deeded week at the Westin in Whistler.
Thank you very much!

There's a Westin timeshare in Whistler?

Yes. It's not a part of Vistana or MVC.
Interesting. Is it an independent or part of a different system? It kind of reminds me of seeing that there's a Sheraton Buganvilias timeshare in Puerta Vallarta. Very confusing.

And, to some degree, the Renaissance Aruba.

That said, I don't think the official resort name is Westin Whistler. Isn't is something like Whiski Jack at the Westin Whistler? I suspect the actual association name has no reference to Westin at all. It looks like there are multiple Whiski Jack properties.

So no Bonvoy ENCs for staying there? Bummer.

Only if you book a stay at The Westin Resort & Spa, Whistler.
After further research it looks like the Whiski Jack resorts either are or were part of the Raintree system. Still seems weird to me that this timeshare location is in a Westin resort, but then again there are other timeshares that have some mixed brand presence.

I've never worked with this resort at all, but I received a call from a past client who asked me to refer her to someone in British Columbia who can assist with the ownership transfer. Property transfers in BC must be facilitated by an attorney or notary in BC.

I would think that LT Transfers might be able to assist or at least point you in the right direction (TUG Members, well recommended). On their generic sales form they do list Canada - BC as available. At the very least they might be able to do the paperwork required which can then be forwarded to the buyer/seller to obtain the signatures. Often law offices, especially this time of year, will have Law Students that have their "stamp". They can witness the signatures and stamp what is required, usually for these simple tasks they will do it for a nominal fee, possibly even free. The one snag could possibly be land titles if its deeded, that might require a little extra work (it does here in Alberta), I would think that LT Transfers would at least be able to get the train on the tracks for your past client.

I’ve used a few different notaries many times in BC for timeshare ownership transfers but it was for non-deeded RTU resorts only in Mexico and I was purchaser.

Was a breeze as all they did was really notarize the sales agreement and signatures taking copies of ID by both seller and purchasers. In all cases the sellers where outside of the province of BC and most outside of Canada getting their stuff notarized and mailed to me for final notarization in BC.

Not sure any of the above helps the specific scenario for whistler other than from perspective any BC notary can do it. I chose from the phone book for one’s nearest to my home. 🤷‍♂️

I have looked at this before. A Notary will not be able to do the job. I am a fan of LT Transfers and have a transaction going with them now, but they will not be able to do this for you in British Columbia

You will need a BC lawyer for this transaction. I would be surprised if you get this done under $1k.

I practice law in Canada, but haven't touched a real estate file in 30 years. Google "property law lawyer" for either Whistler or Squamish. Assuming you are not paying a lot of $$, tell them you do not need a title search or title insurance. That may cut your cost to $400 or 500.
