You can send the other stuff back via USPS Media Mail, but it isn't necessary. The only time you really need to return anything is if they give you anything of significant value that you don't want the full MSRP withheld from a refund. These would be things like a tablet. What all is in the Abound folder? Never return your contract.
It's just a folder with a usb flash drive with contract stuff, passport holders. Nothing expensive like tablet.

It's just a folder with a usb flash drive with contract stuff, passport holders. Nothing expensive like tablet.
I was curious if it contained any type of marketing material, points chart book or anything else about the program or resorts.

Hello,
My mail is still in transit. I had mailed it on April 3rd via USPS certified mail. It is still at Orlando USPS facility. Do they consider the mailing date within 10 days for accepting the cancellation or it should have been delived?

I had also emailed them on April 3rd and a follow-up email today but no response yet.

I am worried as I have to make sure it is cancelled within the 10 day period.

Certified Mail is slower than regular First Class. So being that you mailed it on the third, it isn't surprising it isn't there yet. The date is based on the date you mailed the letter, not when they receive it.

Okay, so that way I am good with the late delivery. What if there is any issue with the delivery and it is not delivered? I have heard several mails were not delivered. What happens then?

Email was / is of no use and of no legal significance with a Wastegate contract rescission, since (AFAIK) an email option is not identified in Wastegate rescission instructions. Wastegate certainly knows that and, accordingly, you may very well never see any response to your emails.

That being said, as already pointed out above, it's only the postmark date on the USPS certified mail sending your signed rescission correspondence that really matters. If postmarked within Florida's rescission period (10 days), delivery date doesn't matter. All will be well. Even slimy Wastegate does not dare to violate the applicable state law regarding contract rescission rights, even though Wastegate can be quite creative when making the rescission instructions difficult to even find in the first place (e.g., printed copy hidden within a velcroed-shut binder seam, or rescission rights and instructions being buried within the contents of a flash drive or CD-ROM).

In any event, you've done what you need to do to rescind. By law, it could take up to 45 days for you to see your deposit refund, although it won't likely take more than a very few weeks, at most. Congratulations :clap:. IMnsHO, Wastegate is not an outfit with which you ever want to become involved. Although their properties are nice enough, virtually everything else about the way Wastegate operates should be avoided like you would avoid a communicable disease (IMnsHO).

P.S. Wastegate may or may not ever bother to send you a separate notification regarding the processing of your cancellation. It may turn out that your only "notification" will be the issuance of 100% of any money you have paid.

Your Postmark is really all that matters, HOWEVER, if you want to sleep better at night just mail it again (copy all your original documents) with a letter explaining why you are mailing it again).

I'm confident you will feel better about it.

Great move to rescind!

Sorry for the mixup; this thread started out with Westgate rescissions as its' topic.

In any event, state law in the state of contract execution determines the rescission period, regardless of the developer involved. The only potential difference in cancellation procedure would be whether or not email (or fax) is specifically identified as an acceptable means of cancellation communication in the developer’s rescission instructions.
With very few exceptions, neither fax nor email communication is adequate or acceptable, but I do not claim to know specifically about Sheraton / Vistana contracts.

You will not get an acknowledgement that they received your rescission paperwork. Besides, you already know they have it according to your green return receipt card.

Be patient. You should receive a refund within 45 days (and sometimes sooner). DON'T reach out to them as they will only try and talk you out of it or offer you a lower price.

If that card was used in any way in the transaction, I'd wait two billing cycles before cancelling it outright. YMMV.

It was used for the partial payment of the timeshare and have got full refund for it. $0 balance card as of now.
