MVC wants to cancel my Harborside trade through Interval.

I own a timeshare in Maine and trade through II generally for Marriott properties. I traded for a week at Atlantis Harborside with a check in next week sept 21. MVC called and said there is now a renovation happening and the room in not available and I cancel with no penalty or they can try to see if there is a hotel room at Atlantis. I told them I expected to be upgraded if it a hotel room. They are getting back to me. What are my rights? My II confirmation says nothing about the resort cancelling.
 
That is most unusual, the II buyers guide is where you will find info on cancellations.

It looks like you have the right to cancel based on the resort accommodation not being available section 8)a)(vii). I can't see anything about them having to guarantee accommodation but could have missed it.

I'd expect you to do well out of this situation as its a Vistana resort, and they have already offered an alternative. Look up what other accommodation is available for your dates using the bonvoy website, and put together a reasonable request that puts you in no worse a position than you would have been in or modestly better. Double check things like the access to Atlantis that you get with harbourside, so you also get that and other things like wi-fi availability, parking etc so you know what they are actually giving you.

My guess is that they could just cancel and do something like give you an accom cert and your week back as compensation it they wanted to play tough. If you want to go on the trip, best you put together the package of what you want that is reasonable but a bit of an uplift so you can make it easy for them to agree to it.
 
It’s in 7 days. So the renovation excuse is BS. All flights and transportation are booked. I asked for the Cove but I don’t know what they will offer. Can they just cancel on me for no reason and I am out all of my travel expenses?

What day are you checking in? In 7 days would seem to indicate a Wednesday or Thursday checkin which I dind't think they had.

It is possible that they have renovations underway and they expected a certain amount of inventory to come back online but now realize that isn't possible and have had to reach out to future guests. You may not be the only one. I suppose you need to wait to see what they come back with. The Cove might be a bit of a reach, but anything is possible.

Sept 21-28 Sunday to Sunday sorry it’s in 4 days and they just contacted me yesterday.

What website? I didn't think Harborside gets listed on Marriott.com. If it is II, perhaps they have pulled all inventory due to delays in renovations?
 
Booked on II but I was called by MVC (Orlando) yesterday. He was suppose to get back to me today sometime. On Marriott it shows Harborside sold out all next week til sept 30Atlantis shows Coral and Harborside not available but Cove and Royal and Reef available. Just not sure what to say if they try to just cancel on me with no substitution.
 
I don't think you can rely on Marriott.com for Harborside availability as I don't think they rent Harborside through Marriott.com. It isn't a Marriott branded property and isn't part of Bonvoy. At this point I would see what they can offer at any of the hotel towers to avoid any loss in other travel expenses you've incurred. You would also want to ensure that there are no resort fees you would have to pay.

I am not aware of any travel insurance which would cover this situation specifically. And by cover I mean either fully reimburse all other trip expenses like airfare, or fully pay for the replacement accommodation.
 
I just want to say that I am so sorry this happened to you. I hope they make it right. It's inexcusable, unless they had some severe circumstance that made the room unavailable. Remodeling doesn't seem like a good excuse.

They have already offered an alternative so there's a good chance they are trying to make it right, they really don't want to have this problem for them or you. If the just wanted to cancel and dump you they would have done that by now.

If you can find a resolution that gives you what you need then that will be great, of all the brands for this to happen with its about the best you could hope for, not least of all because of the linkage to Marriott hotels that they can leverage. The last thing you want is to end up in an un-refurbished harbourside unit, there have been lots of complaints about those for a couple of years. This could be a real gift for you, hope it is. 🙏
 
That’s a good point. I guess they could have just canceled and refunded the trade fee if that is somewhere in the terms. I sent a follow up mail to the customer advocate at MVC. I’ll update when I hear back. Yesterday he said, “we can try to get you a room or you can cancel without penalty” I just wish I was armed with a policy.

Trip insurance would not cover my expenses.
 
Update: MVC email today. We will try to accommodate original stay or you will be moved to Cove or Reef. Very pleased except, for meals expense with no kitchen.

Yeah, the Reef has kitchenette’s & kitchens:


Assuming you’re in a suite. (Since you’re going from a 1 bedroom), it looks like a kitchen to me. It’s also right on the ocean. This should be a considerable upgrade from what you had. Congrats!

I don’t think II has had any full one bedrooms at Harbirside. Only the small with a limited kitchen. Still has a cook top though.

Ah, so the Reef is a definite upgrade then.
 
Building 5 at Harborside had a fire on July 26.

We had a stay there August 10-17, and they put us in building 5. The roof was still under construction. We had tons of problems, including phones not working (which just compounded the other problems) and they were "very inconsistent" (I'm being generous here) in resolving issues and requests. I bet I walked five miles back and forth to the lobby that week, trying to get numerous things taken care of.

I had booked a stay checking in this weekend for some friends of ours, and they've been getting the runaround. Harborside told them that they would be moved to one of the hotels, but they couldn't get any clarification about where. When pressed, Harborside said if they didn't like the ambiguous offer, they would have to cancel the reservation. Harborside cancelled them, but Interval still shows the stay and isn't giving me answers about what they can or will do.

I would recommend avoiding Harborside for the near future.
