Marriott foreclosure without notification!

Marriott foreclosed my parent's timeshare and sold it! We received no letters informing them that it was happening. Anyone else encountered this? I have tried to call and email for more information, and they say they can't do anything and that it is just done.
 
By law, they would have been required to send several notices to your parents at their known address. Is it possible they just thought those letters in the mail were junk and ignored or discarded them?

No, because my father died in 2022 and my mom is in a memory care facility. I am their Power of Attorney. I updated the paperwork through Marriott so that I would receive all of their mail.

How much were maintenance fees past due?

Most fees (for 2026) were due last month but that seems too quick for a foreclosure... were 2025 maintenance fess also unpaid?

I guess their fees weren't paid in 2024 (I thought they were on auto-pay). They sold it March 18, 2025

The first notice probably would have been sent in or around June 2024. This is when the initial lien is filed for the unpaid fees.

When did you contact them with change of address and contact information? Did they tell you at that time that the maintenance fees were past due? My first reaction when I read this thread is that when MF is not paid, Marriott has every right to foreclose on the VOA to avoid further unpaid fees. You would not have been able to sell it with unpaid maintenance fees.

Your underlying assumption appears to be that you lost something of great value without being notified. And that could be true. Without knowing what you owned, it's impossible to be sure. But I believe it's overwhelmingly likely that you DID NOT lose anything of value, but instead are free of an albatross around your neck in the form of a deeded timeshare.

Because many deeded timeshares have zero value, they can't even be given away. And the fact that you can't simply return it to the resort means that you're forced to pay oftentimes sky high annual maintenance fees. Indeed, you didn't even know that maintenance fees weren't paid in 2024 and 2025 (and now in 2026) so none of the four adult children felt any desire to go. Had you paid any maintenance fee, your timeshare would have gone unused and the money would have been entirely wasted.

So let's take a look at a random Marriott timeshare: Grande Vista in Orlando. In particular, let's look at its Redweek sales listings:


Yeah there are nuts out there who are asking $10,000 who will theoretically be waiting for that during the next thousand years, but I think the $1, the $100, and the $250 are the only asking prices even close to being realistic. The annual maintenance fee is over $2000! And rising each year. And you might not know this, but I've seen these advertised as a rentals on Interval International for about $450.

So you might, after checking into YOUR Marriott, be pleased that you've been freed from that burden. And in particular pleased that you didn't waste $6000 (a possible $2000 during each of the last three MF payment years).

Make sure you hit the "See original listing" phrase.

The owner, desperate to sell, has paid his ballpark $2000 2026 maintenance fee and is allowing the buyer to stay this year for free. The owner will pay ALL fees in connection with this transaction including resort transfer fee and closing fee. All the buyer has to pay is $15. And, in my opinion, the owner/seller is lucky to have found at least one person to accept his freebies and agree to put his name on the deed.

Why wouldn't they be able to see Redweek? You don't need to be a member to view listings.

You may be right. As a member, I know I can see listings. But I thought non-members might not. So good, then. He/she can see it all.

Chances are you were helped by this, depending how much was due in arrears and on the location and the season. By the way, what location did they take. Send Marriott a thank you note.

If you want back in. One can purchase a Las Vegas Grande Chateau 2 bdrm lock-off for about $1,500, then pay about $1,500 in annual maintenance fees, and then exchange for two - 1 bdrm weeks through Interval, why worry. $100 per night is a bargain and probably a better deal than your parents had.

By the way, I have traded the Grande Chateau for 1 and even 2 bedrooms in Kauai, Custom House, Branson, Manor House, etc.

I'll just add trying to have four siblings "share" a timeshare sounds like a mess waiting to happen. In my view, usually the sibling that wants to use it the most expects the wealthiest sibling to pay for it (even if they don't use it). This also applies to family camps.
 
You and your siblings could buy your own timeshare weeks, much cheaper than trying to get your parents’ transferred to you. Talk to your siblings they might be glad to just walk away?

Facts aren't mathing with the "Foreclosure without notification!" here:
  • Father dies about 4 years ago
  • Mother in memory care

  • OP guesses "their fees weren't paid in 2024," but does not know
  • OP thought they were on auto-pay, but never received any mail from MVC, never confirmed dues were paid, has no knowledge they were paid.

I am not even aware that Marriott has any kind of auto-pay option.

And yet, he apparently "thought" his parents' account would have been charged. But none of the four siblings had any interest in going despite thinking everything had been paid. I guess it's within the realm of possibility. Just a bit strange.

I agree and don't think there is such a thing for MF's.

Who in heck would be so stupid as to put MF's on autopay anyway. MVC would love this prospect......and it would become a new selling point, right next to you can rent your timeshares to pay your maintenance fees, you can get any reservation you want with points - unlimited supply, etc.

Now the good news - MVC foreclosed on this timeshare for the estate and it's gone, gone, gone. Many of us would pray for this outcome..... Their parents were geniuses in their old age and financial planning.
