Lawsuit/Rancho Banderas

Does anyone know if there's been any progress made in the lawsuit to address the significant increase in yearly assessment fees for this resort? My understanding is the owners agreement caps the amount the fees can go up but several years ago they increased a significant amount, several hundred dollars, and in violation of this agreement. Anything you know or have heard would be helpful, thanks.
