IA Vacations - eBay seller alltimevacations-2008

I bought a timeshare from this group in August, and they have stopped replying to my emails. There is no way I can see that this transaction will be completed by January 1, when the 2012 maintenance fee is due. Will I be expected to pay that if I am not the owner of the timeshare? This is the first timeshare I have bought, and is very likely to be the last. I guess I haven't really bought anything yet.

They seller may ask you to pay the maintenance fee to them, but I wouldn't do it. I'd tell them that you will pay it directly to the resort, after the deed is in your name.

My experience with this company would lead me to recommend that you not pay the maintenance fees until ownership has transferred to you. I had a deal that I cancelled due to length of time waiting. I had paid the maintenance fees upon request and had to argue long and hard to get my money back.

I'm thinking my transfer won't be done before the year ends. I am starting to wonder if the previous owner will be billed for the MFs for 2012. It was my understanding that they had paid 2011 (and I was supposed to have 2011 usage, but Property Relief can never find their own paperwork). As far as I can tell, the county believes I am the owner, but the resort does not. :wall:

Great news for me. I hadn't heard anything about the transfer going through, but I got my 2012 Annual Dues bill yesterday. It was from the resort, so I paid it online and then filled out another form to book my week for next year. I got the confirmation email today. I'm so happy that it is finally DONE! :whoopie:

These sellers are now telling me that the deed I am trying to purchase from them has not been recorded because Marriott is requiring a different POA format. Has anyone heard about that? I read in another thread that this seller wants a POA from buyers, but that they backed down in his case. They won't send me a copy of the deed. I assume POA means Power of Attorney?
I didn't sign anything like that, but am very unsure about what's going on. I "won" an ebay action August 9, but nothing has been recorded yet. Will I have to file a BBB complaint to get anything done?

Did you buy a TS in Hawaii? If you bought something in inland, 5 month is too long to record a deed.
Which county is in your TS?
You can check the deeds from county recorder site.
If it was recorded, you can print it out and send it to the resort with transfer fee.
If you give more info (resort name, location), other tuggers can give better options.
If any closing company cannot record a new deed within 2 months from the purchase date, I would file dispute which always works the best. But you waited 5 months already, so BBB can be a good solution.

Thanks for your reply.
The timeshare is OceanWatch in Myrtle Beach, Horry County, South Carolina. I have been checking the recorded deeds since at least October. I thought the company had sent the deed to Marriott from what they told me, but it hasn't been recorded by the county as yet.
There should be a way for people to buy these ebay timeshares with so much down and the rest when the deal is completed. But when companies have been paid up front they have no incentive to do anything.

Yes. It is the only way they would contact me. It took over 4 months to close. My resort rocks. The staff there are awesome. Looking back, I would have gladly paid more for less of a headache. Good luck.

I would not believe what they say.
Without recorded new deed, how closing co. can send a deed to Marriott?
closing process is very simple.
1) seller get notary public on the new deed
2) closing co. send it to county recorder - for myrtle beach, it takes 3-6 weeks
3) after 3-6 weeks, closing co. will get a new deed and send it to you and send a copy to marriott with a check of transfer fee.
4) these days, it takes only a week to see your week on your marriott account

Threaten them you file complaint to BBB, not only seller but also closing co.

Deeds for Horry County, South Carolina are available on line or by calling them. If it is not recorded, I would file a complaint with the BBB and consider filing one with the State Consumer Protection Agency. Based on what you posted, I do not think you do own the timeshare, at best, you may get use rights for a period of time. I had problems with getting a deed reconized by a major Marriot Competor. The above post is correct, in my case, as it relates to having the deed recorded prior to going Management Group for the Resort.

Thanks for everyone's reply.
Since I have heard nothing about a mintenance fee for 2012, I know I actually own nothing. This may be just as well however, as I now have no fees and no timeshare to worry about getting rid of down the road. People on TUG say timeshares are easy to buy but hard to get rid of. I have found that they are difficult to buy, but easy to pay for. Would I have been better off buying from Marriott for $20,000 and having something, or paying much less on the secondary market but actually owning nothing???

There are some terrific resale companies. Some of them do business on Ebay. I don't know if you would have been happier buying direct, but I am sure you could have purchased at a great price and had great service with other resale companies.

You probably need to file BBB to get a refund. Since you own nothing, the refund should be immediate. You can fill out a form online at the BBB in their area. It is very easy to do. You will magically get a call the next day.

If you see another ad that you would like to bid on, go ahead and ask around here what anyone knows about the seller, and ask for specific feedback. Searching will be beneficial, also. Again, remember that there are some very good, in fact extremely organized and honest resellers out there.

That is possable. Wish you luck resolving the problems. When using E-Bay or similar timeshare service providers what you are experiencing is a possablity for each and every purchase. If you have a copy of the executed deed, you can file it yourself with the county. This does not necessarily mean that Marriott would reconize it. If you do not have a copy of the deed, I would request one be sent that has the signatures of the actual seller(s) of the timeshare.

I bought a timeshare thru IA Vacations July13/11. Here it is Jan8/12 and I still have received nothing from them. I have corresponded with them frequently. They have never initiated any communication with me. I have been told by them that they had wrong info from me (they didn't); that people who have been looking after me were fired or quit;that the deed somehow keeps getting errors on it; etc;etc;. This is my first timeshare purchase and this outfit has made me feel like I've been scammed. I am from Canada and not sure of my legal rights in the States, but I would like to press charges against them. Has anyone else pursued this avenue?

I had a similar situation with them. What ended up getting them moving was when I filed a complaint with the Better Business Bureau in Tennessee. Once I did that, they finally got moving. It may work for you as well.

Similar issues

I also bought through this company in August 2011. The Closing Company had 3 iterations of deed recorded before the 4th was finally correct. I had a face-to-face meeting with the resale company in mid-Dec to discuss their ineptness. They also asked for me to sign a POA for them in order to negate the sale and return my funds. This I refused to do and told them I would wait out their mistakes. They finally agreed to book a weeks vacation in June for me to pacify me. The Wyndham transfer finally occurred and the points hit my account last week. This resale company would not get my recommendation.
